The Ministry of Agriculture and Environment has just issued Decision 2304/QD-BNNMT on the announcement of administrative procedures in the land sector under the state management of the Ministry of Agriculture and Environment, effective from July 1, 2025.
How to re-determinate the residential land area of households and individuals who were granted a Certificate before July 1, 2004 is as follows:
a) Submit directly to the Public Administration Service Center.
b) Submit via postal service.
c) Submit online on the Public Service Portal.

- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree No. 151/2025/ND-CP.

For mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions, the implementation period shall not exceed 30 working days.

- The competent authority decides: Chairman of the People's Committee at the commune level.
- Agencies directly performing administrative procedures: People's Committees at the commune level, agencies with the function of managing land at the commune level, Branches of the Land Registration Office.
Requirements and conditions for administrative procedures (if any):
The re-determination of residential land area is only applicable to cases where residential land plots with gardens, ponds, and residential land of households and individuals have been granted certificates before July 1, 2004, at the time of issuance of certificates, the land user previously had documents on land use rights according to the provisions of Article 137 of the Land Law and now needs to re-determine the residential land area.
