Pursuant to Clause 1, Article 31 of Decree 101/2024/ND-CP, the order and procedures for first-time registration of land and assets attached to land for individuals, communities, and households currently using land are:
Land users and owners of assets attached to land shall submit 01 set of documents as prescribed in Clause 1, Article 28 of this Decree to the dossier receiving agency specified in Point a, Clause 1, Article 21 of this Decree.
Thus, people who need to issue red books need to go to the dossier receiving agency, the One-stop Department according to the regulations of the Provincial People's Committee to carry out this procedure.
According to Clause 5, Clause 6, Article 49 of the Draft Law on Organization of Local Government (amended) from July 1, 2025, it is stipulated as follows:
- Make a red book after the merger of provinces for work and procedures being handled by district-level agencies that have not been completed by July 1, 2025 or have been completed before July 1, 2025 but then arise related problems that need to be resolved: The agency or unit under the local government level where the residence is located will continue to resolve.
- Make a red book after the merger of provinces with related work contents and procedures from 2 newly formed administrative units at the grassroots level after the arrangement or more or with too complicated content: Other specialized/advisory agencies under the provincial People's Committee continue to handle.
- Make red books after merging provinces with investment projects and works under the authority of the district approved but not yet completed by July 1, 2025 or completed before July 1, 2025 but then arise related issues that need to be resolved: People's Committees at the grassroots level where the works and projects are located continue to implement.
- Make red books after merging provinces with related works and projects from 2 newly formed grassroots administrative units after the arrangement or higher or beyond the implementation authority of the grassroots level: Other specialized/advisory agencies under the Provincial People's Committee continue to resolve.
Note, the assignment of authority at this time is done by the Chairman of the Provincial People's Committee.
