On the afternoon of July 23, Gia Dinh Ward People's Committee responded to Lao Dong Newspaper about the situation of many super-thin houses appearing after the clearance to serve the Xuyen Tam canal project.
According to Gia Dinh Ward People's Committee, the whole ward has 869 cases subject to land acquisition for project implementation, including 606 cases of full clearance and 263 cases of partial clearance.
Through review, in 263 cases of partial clearance, there are 214 cases with an area of 9m2 or more and 49 cases with an area of less than 9m2, including land plots originating from canals.
Among these 49 cases, 8 cases are vacant land, without construction works; the remaining 41 cases have existing houses or works and people are still living there.

Regarding the handling of small land plots after recovery, Gia Dinh Ward People's Committee said that Clause 7, Article 91 of the 2024 Land Law stipulates that when the State recovers land to serve national defense, security or socio-economic development for national and public interests, if the remaining land is smaller than the minimum area to be separated according to the regulations of the Provincial People's Committee, land users may agree to let the State recover the remaining area and be compensated, supported, and resettled according to regulations.
Gia Dinh Ward People's Committee said that it has coordinated with Binh Thanh Ward Construction Investment Project Management Board (formerly Binh Thanh District Compensation and Site Clearance Board) to mobilize people to hand over the entire remaining land to be considered for resettlement arrangement.
However, in reality, many households do not agree to recover the entire area but propose to reinforce and keep the part of the project outside the site clearance boundary.
Therefore, for existing works on the remaining land, the government allows them to exist according to the current status, and at the same time only considers repairing and renovating to ensure safety and meet minimum living needs.
The ward does not resolve new construction or expansion of area and scale of works, in order to ensure the progress of compensation, site clearance and project implementation.
Gia Dinh Ward People's Committee also emphasized that, in principle, the remaining area after land recovery but outside the site clearance boundary still belongs to the legal use rights of the people. Current law does not have regulations on mandatory recovery for these small-scale land plots.
To manage construction order, the Ward People's Committee has assigned the Economic, Infrastructure and Urban Department to coordinate with the Binh Thanh Ward Construction Investment Project Management Board to determine boundaries and guide people to implement according to construction permits for eligible cases.
At the same time, functional agencies will record the current status of the project before and after repair to supervise the renovation to the registered scale; strengthen inspection and patrol in areas affected by the project to promptly detect and handle cases of illegal or unlicensed construction (if any).
