According to Clause 1, Article 160 of the 2023 Housing Law, common transactions of buying, selling, leasing, donating, exchanging, mortgaging, and contributing capital with housing must have a Certificate according to the provisions of law.
There are only 5 housing transactions stipulated in Clause 2, Article 160 of the Housing Law below that do not require a Certificate but can still be carried out in accordance with the provisions of law, including:
1. Buying, selling, leasing, mortgaging future housing; selling housing in case of dissolution or bankruptcy.
2. Organize donations to houses of gratitude, houses of love, and houses of great solidarity.
3. Purchase, lease-purchase of existing housing from investors of housing construction investment projects in the following cases: housing belonging to public property; social housing, housing for the people's armed forces, housing serving resettlement not belonging to public property.
4. Renting, lending, letting, authorizing housing management.
5. Receive inheritance of housing.
