The decision clearly states, recovering 11,227.6m2 of land that Bac Ninh Provincial People's Committee has leased to Vinh Hoa Trading Company - (LLC) to build a general commercial service area, restaurants, and hotels in Thuan Thanh ward according to the decision dated June 29, 2017.
Hand over this recovered land area to the Provincial Land Fund Development Center for management and exploitation according to regulations.
Reason for land recovery: Vinh Hoa Trading Company - (LLC) violated the land law stipulated in Clause 8, Article 81 of the 2024 Land Law.
Bac Ninh Provincial People's Committee assigned the Department of Agriculture and Environment to regularly urge, inspect, and resolve arising issues in the process of implementing the Decision.
At the same time, directing the collection and submission of Land Use Right Certificates according to regulations and other related contents.
Directing the Bac Ninh Provincial Land Registration Office to update and adjust cadastral records and land databases according to regulations.
In case Vinh Hoa Trading Company - (LLC) does not implement the land recovery decision, Thuan Thanh Ward People's Committee is assigned to organize coercion to implement the land recovery decision according to regulations.
It is known that Clause 8, Article 81 of the 2024 Land Law clearly stipulates:
Land allocated or leased by the State to implement investment projects, if the land is not put into use or the land use progress is delayed compared to the progress recorded in the investment project, the investor is granted an extension of use for no more than 24 months and must additionally pay to the State the amount corresponding to the land use fee and land rent for the extended period.
After the extended term expires, if the investor has not yet put the land into use, the State will recover the land without compensation for land, assets attached to the land and remaining investment costs in the land.
