Delayed payment of health insurance, businesses are fined according to the level of violation
Decree No. 90/2026/ND-CP of the Government on sanctioning administrative violations in the field of health officially takes effect, stipulating many strict penalties for acts of late payment and evasion of health insurance (HI), with a maximum fine of up to 70 million VND.
According to new regulations, employers who do not make a list or make incomplete lists of health insurance participants within the prescribed time limit will be penalized depending on the number of violating workers. The fine ranges from 1 - 2 million VND if the violation is less than 10 workers, and can be up to 25 - 35 million VND if the violation is 1,000 people or more.
For acts of late payment or incomplete payment of health insurance money, the fine is calculated according to the value of the violation. Specifically, the lowest level is from 500,000 VND and the highest is up to 35 million VND, depending on the amount of late payment.
In addition to administrative penalties, businesses are also forced to remedy consequences such as: Paying the remaining amount, returning the affected benefits to participants (if any), paying illegal profits and bearing late payment interest at a rate of 0.03%/day.
Evading health insurance contributions may be fined up to 70 million VND
Notably, the act of evading health insurance contributions is punished more severely. In cases where violations have not reached the level of criminal prosecution, the fine for individuals may be from 300,000 - 500,000 VND.
For employers, if they do not make a list or make a short list of people who must participate in health insurance after the prescribed time limit, the fine may be from 2 - 4 million VND (under 10 workers) and gradually increase, up to 50 - 70 million VND if they violate from 1,000 workers or more.
In addition, the act of declaring salary as a basis for paying health insurance lower than regulations or not paying, paying less after being urged will also be fined from 1 million to 45 million VND, depending on the value of the violation.
Remedial measures include: Forcing the full amount of evaded contributions to the health insurance fund, refunding damages to participants (if any), and returning illegal profits and arising interest.
Borrowing, using incorrect health insurance cards is also penalized
Decree 90 also tightens the use of health insurance cards in medical examination and treatment. The act of lending cards to others or using other people's cards will be fined from 1 - 2 million VND if it has not caused damage.
In case of using health insurance cards for personal gain, causing damage to the health insurance fund, the fine may be from 3 - 5 million VND, and at the same time, it is mandatory to refund the violated amount.
The increase in penalties is expected to raise the awareness of law compliance of businesses and people, contributing to ensuring the rights of health insurance participants and the safety of the insurance fund.
