Pursuant to the provisions of Point b, Clause 1, Article 137 of the 2024 Land Law as follows:
Article 137. Issuing Certificates of land use rights and ownership of assets attached to land for households, individuals, and communities currently using land with documents on land use rights
1. Households and individuals who are using land stably and have one of the following documents established before October 15, 1993 shall be granted a Certificate of land use rights and ownership of assets attached to land and shall not have to pay land use fees:
a) Documents on land use rights issued by competent authorities during the implementation of land policies of the Democratic Republic of Vietnam, the Provisional Revolutionary Government of the Republic of Vietnam and the Socialist Republic of Vietnam;
b) One of the documents on land use rights issued by a competent authority under the old regime to a land user, including: Land lease contract; Property for real estate with certificate from an agency under the old regime; Property for house sale, house donation, house exchange, house inheritance attached to residential land with certificate from an agency under the old regime; will or agreement on inheritance of housing certified by an agency under the old regime; Housing construction permit; Architectural legalization permit of an agency under the old regime; Judgment of a Court under the old regime that has come into effect;
Accordingly, a land plot contract if issued to a land user by a competent authority under the old regime, specifically a household or individual using the land stably, is considered a legal document to issue a red book.
