Secret to successfully buying social housing in Hanoi

Hanoi - The demand for social housing in the capital is currently a "hot" issue that attracts the attention of many people.

Although the conditions for enjoying policies and procedures for confirming documents to buy, rent, and lease social housing (NOXH) have been strictly regulated, in detail and publicly, not everyone is well aware.

A series of social housing projects are being implemented

According to the Housing Development Program for the period 2021-2030 and the Housing Development Plan for the period 2021-2025 of Hanoi City that have been approved, the Prime Minister assigned Hanoi to complete the target of 100,000 apartments by 2030.

Currently, there are over 20 social housing projects updated in the Hanoi Housing Development Plan for the period 2021-2025, it is expected that the whole city will add about 1,462,000m2 of floor space, equivalent to about 19,730 apartments in the period after 2025. The total area of social housing floors expected to be completed in the 2021-2025 period is about 1,016,000m2 (equivalent to about 16,540 apartments); the post-2025 period is about 6,294,000m2 (equivalent to about 91,450 apartments).

In the coming time, Hanoi will implement many social housing projects in areas with high demand, to ensure synchronization with the city's socio-economic development in each stage. Typically, Him Lam Phuc Loi social housing projects with more than 3,000 apartments invested by Himlam Capital Joint Stock Company, or Uy No Dong Anh social housing project with nearly 500 apartments invested by 319 Ministry of National Defense Corporation, social housing project in Kim Chung New Urban Area invested by a joint venture of Hanoi Housing Investment and Development Corporation (Handico) and Viglacera Corporation with 1,104 apartments...

The goal is to associate with an 8% growth rate by 2025 and achieved two-digit growth in the period 2026-2030, according to the policy of the City Party Committee, People's Council and People's Committee; At the same time, contributing to the development of the private economy in the area, in the direction of the Government.

Regulations that need to be clearly understood

According to Article 76 of the Housing Law 2023, groups of subjects entitled to social housing policies in projects include:

- People with revolutionary contributions, relatives of martyrs.

- Poor and near-poor households in urban and rural areas, and areas frequently affected by natural disasters and climate change.

- Low-income people in urban areas.

- Workers and employees in enterprises, cooperatives, and cooperative unions inside and outside industrial parks.

- Armed forces (military, police), weak operations.

- Cadres, civil servants, and public employees receiving budget salaries.

- The person who returned the official residence.

- People whose land has been recovered and whose houses have to be cleared or demolished but have not been compensated by the State with houses or residential land.

- Students (only allowed to rent a house during their study period).

- Enterprises, cooperatives, and cooperative unions in industrial parks are allowed to rent workers' accommodation.

In addition to being in the above target groups, to enjoy social housing support policies, people must also meet the housing and income conditions as prescribed in Articles 29 and 30 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government. The Ministry of Construction has also issued Circular No. 05/2024/TT-BXD dated July 31, 2024, providing detailed instructions on documents proving the subjects and conditions for enjoying the policy. This regulation aims to ensure fairness and strictness in the management and development of social housing.

Before conducting business (selling, leasing, leasing), the investor of the NOXH project is responsible for reporting in writing the total number of apartments expected business, time, location and form of receipt. The Hanoi Department of Construction will check and publicize this information on the website/portal, so that people need to apply directly to the investor. The order of approval and signing of contracts is specified in Article 38 of Decree No. 100/2024/ND-CP and is subject to strict management and inspection of state agencies in order to identify the right subjects and ensure transparency.

However, the current reality shows that the price of commercial housing in Hanoi is very high. Many people find the advantage of investment when buying social housing due to the support of support policies, the purchase price is only about 1/3 compared to commercial houses. Therefore, there are many people looking for ways, asking relatives in the name of the dossier to legalize the registration conditions, though not really need to accommodate. Even in some cases, the name is not eligible but still carry out the procedure to confirm and seek to connect with the trigger and brokerage to falsify the dossier to profit from the State's humanistic policy. This behavior violates the law, and at the same time puts great pressure on the government and the investor in the review of the dossier.

Through field surveys in some projects, the number of people interested and registered to guide the application is huge. However, only about 20% of them would like to fully confirm and meet the conditions for buying and to enjoy the social insurance policy. Most of the remaining cases do not know the rules, or do not apply for full confirmation of the documents, confirm the wrong content in the form in accordance with the law and above all a large number of people do not really have a housing demand, but only aim to ask family members to buy investment.

Therefore, people need to proactively study current legal regulations carefully to prepare correct and complete documents, ensuring the right to buy, rent or lease social housing. At the same time, it is necessary to directly contact the competent state agency or project investor for detailed instructions, avoid using intermediaries to cause legal risks, violate the law and distort housing support policies for disadvantaged people and people in real difficulties.
