Citizens send questions to the Ministry of Agriculture and Environment with the content:
I am a Vietnamese person of Vietnamese origin residing abroad, and have a need to carry out procedures to renew the Certificate of Land Use Rights due to personal information change from the old identity card to a foreign passport.
According to the provisions of Point II. 2.5, Part B of the Appendix issued together with Decree No. 151/2025/ND-CP, in case of changing information about land users, for overseas Vietnamese, they must submit a document from a competent authority authorizing or recognizing the change of information according to the provisions of law.
So, what types of documents does the competent authority's document in this case include and which agency issues them to be considered valid?
The Ministry of Agriculture and Environment has the following opinions:
According to the provisions of point b, section 5, part II. 2.5, part B of Decree 151/2025/ND-CP, for people of Vietnamese origin residing abroad who have a need to reissue a Certificate of Land Use Rights due to changes in personal information, "documents from competent authorities allowing or recognizing name changes or information changes" are understood as legal documents showing current personal information.
These documents include: (i) A valid foreign passport issued by the competent authority of the host country; (ii) Foreign civil status documents such as name change certificates, civil status correction certificates, birth certificates, marriage/divorce certificates; (iii) Personal information confirmation papers issued by the residence management agency or foreign civil status agency; and (iv) Related Vietnamese documents (if any) such as confirmation of the old ID card number or personal identification number.
Documents issued by foreign agencies must be consularly legalized (except for exemptions) and translated into Vietnamese, certified according to regulations.
The Ministry of Agriculture and Environment informs citizens to know and contact competent authorities in the locality to be considered and resolved according to the provisions of law.
