The Ministry of Agriculture and Environment received a petition from voters in Dong Nai province with the content: "Voters propose to consider adjusting the land price policy for compensation, support and resettlement when the State recovers land in a direction close to market prices, ensuring the legitimate rights and interests of people whose land is recovered. At the same time, there needs to be a synchronous solution on resettlement, supporting the stabilization of life and livelihoods for people after land recovery".
Regarding this proposal, the Ministry of Agriculture and Environment reports to the National Assembly Delegation and voters of Dong Nai province as follows:
The 2024 Land Law and documents detailing the implementation of the Land Law have many new regulations to better ensure the rights of people whose land is recovered such as: Diversifying forms of compensation in cash, land, and housing; Supports such as: support for stabilizing life; support for stabilizing production and business; support for relocating livestock; support for training, career change and job search; support for resettlement; other support; Compensation for damage to housing and living facilities at new construction unit prices with equivalent technical standards if not meeting technical standards as prescribed;
The resettlement arrangement must be completed before a land recovery decision is made; the resettlement area ensures conditions on technical infrastructure, social infrastructure and is consistent with cultural traditions, customs and habits of the residential community where the land is recovered; prioritizing on-site resettlement. At the same time, the Land Law also stipulates that people who are arranged for resettlement are allowed to record land use fees when they are allocated resettlement land (Clause 3, Article 111 of the Land Law, Article 26 of Decree No. 88/2024/ND-CP); supporting sufficient money to be allocated a minimum resettlement quota for people who are compensated with residential land if the compensation for residential land is not sufficient compared to the value of a minimum resettlement quota (Clause 8, Article 111 of the Land Law).
The land price for calculating land compensation and the land price for calculating land use fees when allocating resettlement land are shown in the content of the compensation, support, and resettlement plan and this plan is approved before the land acquisition decision (Clause 6, Article 91 of the Land Law, Clause 2, Article 3 of Decree No. 88/2024/ND-CP).
At the same time, on December 11, 2025, the National Assembly issued Resolution 254/2025/QH15, which stipulates that the land price for calculating land compensation and the land price for calculating land use fees at the resettlement area are calculated according to the land price in the land price list and the land price adjustment coefficient (Clause 6, Article 3). The land price list according to the 2024 Land Law and Resolution 254/2025/QH15 are built regardless of the land price frame; the survey and collection of information to build land price lists and land price adjustment coefficients is based on information on land use right transfer prices; winning bid prices for land use rights after completing financial obligations;...
Therefore, the land price list and land price adjustment coefficient have gradually approached market prices. In the coming time, the Ministry of Agriculture and Environment will continue to research and improve policies on compensation, support and resettlement when the State recovers land to suit reality, better ensuring the legitimate rights and interests of people whose land is recovered.
