The Ministry of Agriculture and Environment received a petition from voters in Bac Ninh province with the content: On October 17, 2025, the Steering Committee for arranging administrative units at all levels and building a 2-level local government organization model has Official Dispatch No. 20/CV-BCĐ on establishing public non-business units providing multi-sectoral and multi-field non-business services at the commune level. It is proposed to soon have a document directing localities to organize the implementation of arranging the model of the Inter-Commune Land Registration Office Branch. For the Land Fund Development Center Branch, it is proposed to implement according to the provisions of land law or consolidate according to the guidance of the Steering Committee in Official Dispatch No. 03/CV-BCĐ.
Regarding this proposal, the Ministry of Agriculture and Environment reports as follows:
Implementing the organization of local government at 02 levels, the Ministry of Agriculture and Environment has advised the Government to issue Decree No. 151/2025/ND-CP, which stipulates: The Land Registration Office has specialized departments and Branches of the Land Registration Office. Branches of the Land Registration Office are located at commune-level administrative units or inter-commune and ward areas decided by the Provincial People's Committees.
This regulation has decentralized to the Provincial People's Committee to decide on the arrangement and organization of Branches of the Land Registration Office located in commune-level administrative units or inter-commune and ward areas to suit the local reality.
According to the provisions of Clause 3, Article 16 of Decree 151/2025/ND-CP and Clause 6, Article 1 of Decision No. 2418/QD-BNNMT dated June 28, 2025 of the Minister of Agriculture and Environment on correcting Decree No. 151/2025/ND-CP: The land fund development organization is a public non-business unit established by the Provincial People's Committee directly under the Provincial People's Committee. Based on the actual situation in the locality, the Provincial People's Committee decides to establish a regional land fund development branch.
Land fund development organizations, Branches of regional land fund development organizations have legal status, have their own seals, and are allowed to open accounts to operate according to the provisions of law for public non-business units and have tasks, organizational structure, apparatus, autonomy mechanism, financial revenue sources, expenditures, and operating coordination regulations according to the provisions of Clauses 2, 3, 4, 5 and 6, Article 14 of Decree No. 102/2024/ND-CP. Public non-business units under the People's Committees of communes are allowed to perform the tasks of land fund development organizations specified in Points b, c, d, d, g and i, Clause 2, Article 14 of Decree No. 102/2024/ND-CP.
Accordingly, the Provincial People's Committee decided to establish a Branch to organize the development of regional land funds to suit the actual situation in the locality and ensure the effective implementation of tasks.
