On the Government Portal, citizens wondered:
My family has a residential land plot in the countryside. According to the diagram, the land plot is adjacent to a part of the concrete road, but that is the separate road of another house, my family is not allowed to use it.
My family and adjacent households agreed to open a 1.5m wide path running along the land plots to make a common road and made a record of agreement. In fact, that road exists and is being used. However, when registering land changes with the ward to update that road into the land plot diagram, they were told that it was not allowed. So how can my family and adjacent households have a road and update land changes in accordance with the law?
The Ministry of Agriculture and Environment answers this question as follows:
Land law has regulations on registration of land changes in Article 133 of the 2024 Land Law.
The guidance on showing the preliminary land plot and assets attached to land on the Certificate is implemented according to the provisions of Appendix No. 03 of Circular No. 10/2024/TT-BTNMT dated July 31, 2024 of the Minister of Natural Resources and Environment (now the Ministry of Agriculture and Environment) regulating cadastral records, Certificates of land use rights, ownership of assets attached to land.
Currently, according to the provisions of Article 14, Article 15 of Decree No. 49/2026/ND-CP, the Government has assigned provincial-level People's Committees to decide on authority and regulations on procedures and administrative procedures for land, including procedures for registration and issuance of Certificates of land use rights and ownership of assets attached to land.
The Ministry of Agriculture and Environment informs citizens to know and study to implement according to the provisions of law, if there are still problems, send petitions to the Provincial People's Committee or the Department of Agriculture and Environment where the land is located for answers according to their authority.
