However, in recent times, in some social housing projects, there have been cases of large crowds, jostling, taking positions; people lining up all night, making tu-number lists, holding positions, posing a potential risk of dispute causing disorder; arising illegal brokerage, "profile brokers", collecting money to keep places outside regulations, causing frustration and affecting the image and effectiveness of social housing policies.
If the above situation is not corrected promptly, it will not only cause disorder but also pose a potential risk of negative consequences, creating a favorable environment for "brokers" and brokers to receive money " worrying about documents", selling "diplomatic goods" ... not in accordance with regulations, distorting policies, affecting people's trust and making it difficult for state management in the locality.
To ensure the reception of documents for the purchase and rental of social housing is carried out in an orderly, transparent, convenient and in accordance with legal regulations, the Ministry of Construction requests the People's Committees of provinces and centrally run cities to direct the implementation of a number of tasks and solutions as follows:
Direct the Department of Construction and relevant agencies:
Urge social housing projects in the area to speed up progress and put the project into operation soon.
Publicly announce information for all projects being implemented in the area, at least 30 days before receiving documents. The disclosure content includes information: Project scale, apartment number, selling price, purchase rental price, time - location of document issuance; start - end time for document receipt...
The disclosure must be done simultaneously on the website of the Department of Construction, the People's Committee of the commune where the project is located and at least once in the newspaper as the mouthpiece of the local government.
Guiding people to prepare documents and records to prove their subjects and conditions in full, avoiding having to supplement and travel many times.
Direct agencies and units with social housing registration or local competent authorities to confirm the subjects, income conditions, and housing conditions for subjects according to the form of Circular No. 32/2025/TT-BXD dated November 10, 2025 of the Minister of Construction.
Direct local police to coordinate with the People's Committees of communes where the project is located and the investor to develop a plan to ensure security and order, and regulate traffic, avoiding crowded gatherings and jostling.
Notably, the Ministry of Construction proposed to publicize the list of people eligible to buy or rent social housing after signing the contract and update the list of subjects eligible to buy or rent social housing on the Department of Construction's electronic information page to serve post-inspections, to avoid duplication of subjects.
Direct the authorities to check and handle acts of: illegal brokerage, "brokerage", collecting booking fees, collecting fees to "guarantee winning documents", and selling "diplomatic exchanges" in violation of regulations.
Publicly announce organizations and individuals who violate to warn people.
Strengthen information and communication work on social housing policies in the area so that people have a grasp of the policy and avoid being deceived.
Strengthen post-inspection and handling of violations: regularly check the management and use of social housing; strictly handle and recover apartments for cases of false declaration, transfer against regulations or to the wrong subjects.
The Ministry of Construction also directs investors of social housing projects:
Strictly implement the procedures for buying and selling social housing according to the provisions of law.
Publicly announce information about social housing projects on the information page of your business, and at the same time send information about the project to the Department of Construction and the People's Committee of the commune where the project is located for announcement and posting on other official local information channels according to regulations.
For direct submission of documents:
Request investors to arrange many reception points; divide them into time frames, days, or residential areas, have signs to guide, and have support forces to regulate and divert water to avoid concentrating at one time.
Investors must have a backup plan when the number of petitioners exceeds their ability to receive.
In case it is necessary to extend the time for receiving documents, promptly publicly notify at the locations for receiving documents, the mass media and report to the competent authority to ensure that all registered users receive documents.
Encourage the application of digital technology: receive documents online, queue electronically, distribute documents online to reduce the number of people coming directly.
The Ministry of Construction recommends that home buyers in households should proactively study legal regulations to avoid taking advantage and profiteering.
Proactively learn about information about social housing in the area through official channels such as: Department of Construction's Electronic Information page, People's Committee at the commune level where the project is located, newspapers as the mouthpiece of local authorities, and the official information page of the Investor.
Only work directly, following the instructions of the investor's staff and employees; do not buy - sell through "brokers", brokers or trust in "diplomatic contracts" or "internal contracts".
Follow the instructions of staff or security forces at the point of application submission, do not jostle or push.
Declare and be responsible for the authenticity of the registration documents; only submit documents at one project, without having others to be the household registration documents.
The Ministry of Construction is proposing a new draft Decree on administrative sanctions in the construction sector to tighten management and handle violations in profiteering, buying and selling, or misusing social housing (NOXH) purposes.
Accordingly, a fine of 80 - 120 million VND will be applied to acts of the lessee or lessee not using the housing for the purpose of living for himself or his family members. The buyer or lessee of social housing for reselling the house is not in accordance with regulations; the advance payment from the social housing buyer is not in accordance with regulations.
The draft also stipulates other fines such as a fine of VND 120 - 160 million for the act of selling, leasing, leasing, or purchasing social housing for the wrong subjects or not complying with conditions.
