According to the draft, the revised Real Estate Business Law will focus on major policy groups, throughout the entire content of the law.
The focus is on amending and supplementing regulations on housing business and existing construction works; housing business, construction works formed in the future; business of land use rights with technical infrastructure in real estate projects; transfer of real estate projects.
The Ministry of Construction said that the Real Estate Business Law in 2023 has been implemented for more than a year. However, along with socio-economic development, many new requirements have arisen, especially the arrangement and adjustment of administrative boundaries, reorganizing the state administrative apparatus and deploying the two-level local government model. These changes require researching and amending and supplementing the provisions of the law to suit reality.
One of the notable contents is the issue of decentralization and delegation of power in the real estate business sector.
The Ministry of Construction said that the draft law will institutionalize in accordance with the spirit of direction on decentralization and delegation of power, ensuring compliance with relevant regulations, including Decree No. 144. 2025. ND-CP on decentralization and delegation of power in the construction sector.
In addition, the legal system related to the real estate market such as land, construction, urban and rural planning, investment, notarization, urban classification... has been and is being amended and supplemented.
This raises the requirement to adjust the Law on Real Estate Business to ensure uniformity and synchronization in the legal system.
The draft law also aims to remove difficulties and obstacles arising in the implementation process, handle bottlenecks, thereby promoting the stable development of the real estate market.
Some contents are proposed to be amended to simplify administrative procedures, reduce compliance costs for businesses, and increase autonomy in investment and business activities.
Regarding policies associated with urban classification, the Ministry of Construction said that the Real Estate Business Law in 2023 is currently stipulating conditions for transferring land use rights that already have technical infrastructure in the project based on urban classification criteria according to previous resolutions.
However, on December 24, 2025, the National Assembly Standing Committee issued Resolution No. 111. 2025. UBTVQH15 on urban classification. Therefore, it is necessary to adjust the corresponding regulations in the law to ensure compliance with the new regulations.
In addition, the draft also reviews general regulations to clarify the scope of regulation and subjects of application of the law, creating more favorable conditions for implementation.
Specific regulations on real estate business such as housing transactions, construction works, project transfer, real estate business contracts... will be adjusted in the direction of synchronization with relevant laws and in accordance with the two-level local government model.
Notably, the draft proposes to build a real estate transaction process that connects information and data with information systems and databases on housing and the real estate market.
Data interconnection in the electronic environment is expected to contribute to improving transparency and reducing transaction risks.
For the real estate service sector, the Ministry of Construction proposes to cut and simplify the operating conditions of real estate exchanges, as well as conditions for organizations and individuals doing brokerage service business. At the same time, improve regulations on training and fostering professional knowledge of brokerage and management and operation of exchanges.
Another important content is to complete the legal framework for information systems and databases on housing and the real estate market. According to the Ministry of Construction, in the context of accelerating national digital transformation, building a digital government and developing a digital economy, the construction, management and exploitation of this data system need to be carried out synchronously, unifiedly, accurately and safely.
The data system is connected and shared between management agencies from central to local levels, which will contribute to improving information quality, increasing transparency and reliability of the market. At the same time, providing public data for people, businesses and investors, thereby creating a transparent and competitive business environment, limiting risks, speculation and the situation of pushing up real estate prices.
The Ministry of Construction emphasized that, from the arising reality, the overall review and amendment of the Real Estate Business Law in the current period is extremely necessary to ensure a healthy, stable and sustainable market development.
