Mr. T.V. T's mother (Ninh Binh) is a youth volunteer, has a certificate of participation in frontline civilian labor and is entitled to a one-time allowance according to Decision No. 49/2015/QD-TTg. Mr. T asked, does his mother belong to the category of people with meritorious services and is prioritized to buy social housing?
The Ministry of Construction answers this question as follows:
Clause 1, Article 76 of the 2023 Housing Law stipulates the subjects entitled to social housing support policies:
1. People with meritorious services to the revolution, relatives of martyrs who are eligible for housing improvement support according to the provisions of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution".
Point m, Clause 1, Article 3 of Ordinance No. 02/2020/UBTVQH14 dated December 9, 2020 of the National Assembly Standing Committee on Preferential treatment for people with meritorious services to the revolution stipulates:
1. People with meritorious services to the revolution include:
m) People who have contributed to helping the revolution".
Clause 1 and point d, clause 2, Article 99 of Decree No. 131/2021/ND-CP dated December 30, 2021 of the Government detailing and implementing measures of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution stipulate:
1. Supported subjects
Subjects eligible for housing improvement support are subjects specified in points a, b, d, đ, e, g, h, i, k, l, m in Clause 1, Article 3 of the Ordinance and relatives of martyrs.
2. Forms of housing support
d) Supporting the settlement of the purchase, lease, and lease-purchase of social housing not invested and built by the State in accordance with the law on housing...".
Based on the above regulations, if his mother is a person with meritorious services specified in point m, clause 1, Article 3 of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution, she is eligible to buy social housing.
The confirmation of people with meritorious services according to the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution is under the guidance authority of the Ministry of Home Affairs.
