The Ministry of Construction has Official Dispatch No. 12068/BXD-KTQLXD sent to the Committee for Petitions and Supervision of the National Assembly, the Delegation of National Assembly Deputies of Ho Chi Minh City to respond to the recommendations of voters in Ho Chi Minh City sent after the First Session, 16th National Assembly.
According to the content of the petition, voters proposed to soon complete legal regulations allowing people in the suspended planning area to be granted temporary construction permits, repair and renovate solid houses to ensure safety and stability of life while waiting for planning implementation.
After researching, the Ministry of Construction answers this question as follows:
On June 19, 2026, the Government issued Decree No. 217/2026/ND-CP detailing a number of articles of the Construction Law on construction activity management (effective from July 1, 2026). Article 52 of the Decree stipulates the conditions for issuing construction permits for a limited term. In which, Clause 1 of this article has stipulated general conditions for issuing construction permits for a limited term, with some specific contents as follows:
“a) Belonging to areas planned according to the law on urban and rural planning or sectoral planning or sectoral detailed planning approved and announced by competent state agencies but not yet implemented and without land recovery decisions from competent state agencies...
d) When the validity period of the project recorded in the term construction permit expires and the competent authority has a decision to recover land, the investor commits to self-demolish the project, if they do not self-demolish, they will be coerced and bear all costs for demolition. In case the plan has not been implemented after this time limit, the investor is allowed to continue using the project until the competent authority has a decision to recover land. Compensation, support, and resettlement when recovering land and demolishing the project are carried out in accordance with the provisions of land law.
The Ministry of Construction respectfully sends the Delegation of National Assembly Deputies of Ho Chi Minh City to inform voters; sends to the Committee for Petitions and Supervision of the National Assembly to summarize, monitor, and supervise according to regulations.
