The Ministry of Construction's agency has just responded to citizens' questions about subjects who do not have a construction permit.

On the Ministry of Construction's Information Portal, reader D. T. N wondered:

According to the provisions of point d, clause 2, Article 43 of the Construction Law No. 135/2025/QH15, advertising works are not subject to construction permits according to the provisions of the law on advertising; passive telecommunications technical infrastructure works.

So, for the adjacent house area that has been approved for 1/500 scale planning and has been put into use, if you want to install more passive telecommunications base transceiver, do you need to apply for permission to adjust the 1/500 scale planning? Because it changes the facade architecture, changes height, changes structure and increases the load-bearing capacity of the adjacent house project?

Answering this question, after research, the Department of Economics - Construction Investment Management (Ministry of Construction) has the following opinion:

According to the provisions of point d, clause 2, Article 43 of the 2025 Construction Law (effective from January 1, 2026): "Advertising works are not subject to construction permits according to the provisions of the law on advertising; passive telecommunications technical infrastructure works" are not subject to construction permits.

It is requested that you, citizens, study and apply it according to legal regulations.
