On the Ministry of Construction's Information Portal, citizen N.V.H wondered:
I have household registration in another province, registered for long-term temporary residence in Hanoi, and have a need to buy social housing. I am working as a teacher at a private preschool group, operating based on the establishment decision of the Ward People's Committee, and have monthly social insurance contributions.
The class group does not have business registration and a full legal seal. So am I classified as low-income people in urban areas with labor contracts or not?
If it belongs to the above subjects, is it considered valid if the head of the child group or class group only signs and certifies the forms to prove income, prove the subject and the salary scale without a legal seal?
If it is not valid, what should I do? In fact, I am living and working stably in Hanoi, and cannot be classified as a freelancer. I request to be explained what the regulations on low-income people in urban areas with labor contracts are?
The Ministry of Construction answers this question as follows:
Clause 5, Article 76 of the 2023 Housing Law stipulates the subjects entitled to social housing support policies as follows: "5. Low-income people in urban areas".
Clause 1, Article 78 of the 2023 Housing Law stipulates that subjects specified in Clauses 1, 4, 5, 6, 7, 8, 9 and 10 of Article 76 who meet housing conditions and income conditions specified in this clause are eligible to buy or lease social housing.
On April 7, 2026, the Government issued Decree No. 136/2026/ND-CP amending and supplementing a number of articles of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on development and management of social housing (amended and supplemented in Decree No. 261/2025/ND-CP and Decree No. 54/2026/ND-CP) stipulating as follows:
1. For subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law, the following income conditions must be ensured:
a) In case the applicant is a non-married person or is certified as single, the average monthly actual income does not exceed 25 million VND calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
In case the applicant is a non-married person or is certified as single and is raising a minor child, the average monthly actual income does not exceed 35 million VND calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
b) In case the applicant is married according to the provisions of law, the applicant and their spouse have a total average monthly actual income of no more than 50 million VND calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works".
In Form No. 01a of Circular No. 32/2025/TT-BXD dated November 10, 2025 of the Minister of Construction amending and supplementing a number of articles of Circular No. 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction detailing a number of articles of the Housing Law (amended and supplemented in Circular No. 08/2026/TT-BXD dated February 15, 2026 of the Minister of Construction), in which documents proving subjects and income to enjoy social housing support policies (applied to subjects specified in Clauses 5, 6, 8, Article 76 of the Housing Law, except for subjects specified in Clause 5, Article 76 of the Housing Law who do not have labor contracts, do not receive pensions paid by the social insurance agency) are certified by the agency, unit, and enterprise where the declarant is working and must be signed and stamped (with legal status) according to this Form.
The Ministry of Construction would like to acknowledge your opinion to summarize and study to improve legal regulations on housing in the coming time.
