The Ministry of Construction has just issued Official Dispatch No. 12974/BXD-KTQLXD dated August 18, 2026, sent to Ministries, ministerial-level agencies; People's Committees of provinces and cities on improving the efficiency of management of construction activities.
According to the Ministry of Construction, in the past time, the management of construction activities, especially for important national projects and key projects, has made strong breakthroughs, contributing to improving the effectiveness and efficiency of state management and promoting socio-economic development, ensuring national defense and security.
Currently, the National Assembly, the Government, Ministers of Ministries, Heads of ministerial-level agencies and the Minister of Construction have issued many legal documents related to construction investment, gradually perfecting the legal system, fully and strictly regulating the content, order, and procedures in construction activities.
Accordingly, the management mechanism has thoroughly decentralized between the Central Government and localities, clearly defining responsibilities between investors and investors in order to improve the effectiveness and efficiency of management, limit overlap in task implementation, strengthen the proactiveness of localities and investors; and at the same time create a foundation for the effective use of investment resources, meeting the requirements of socio-economic development in the current period.
This decentralization and delineation of authority contributes to enhancing the autonomy of local authorities, investors and entities, shortening the time to resolve administrative procedures, and ensuring uniformity in state management through inspection, supervision and examination mechanisms. In addition to decentralization and delineation of responsibilities, the law also specifically stipulates the rights, obligations and responsibilities of each entity participating in construction activities, including state management agencies, investors, investors, contractors, consulting units and related organizations and individuals.
These regulations create a clear legal basis for entities to properly perform their assigned functions and tasks, while improving transparency, accountability and management efficiency throughout the investment process.
Besides the achieved results, through inspection, auditing, and inspection of the compliance with policies and laws on construction investment for a number of large projects and key projects, the State Audit Office and the Government Inspectorate have pointed out some shortcomings and limitations in the project implementation process, including: project approval procedures; project management capacity conditions; the work of preparing, appraising, and approving bidding package estimates; contractor selection; contract implementation management (avance, acceptance, payment, etc.).
To promptly rectify and draw common lessons, strengthen discipline and order in management of construction investment and prevent and stop existing problems and limitations, in order to raise awareness and responsibility of subjects participating in construction activities, it is proposed that ministries, ministerial-level agencies and People's Committees of provinces and cities continue to strengthen discipline and order, improve the capacity and responsibility of organizations and individuals in the process of managing construction activities; at the same time, direct agencies and units under management to promptly review, rectify, and overcome existing problems and limitations (if any) throughout the construction investment process, from the project preparation stage, project implementation to acceptance, handover, finalization and completion of construction; in which, focus on reviewing and rectifying compliance with legal regulations on construction investment procedures, investment cost management, contractor selection, management and implementation of construction contracts.
At the same time, directing investors, project management boards, consulting organizations, contractors and related organizations and individuals in the process of performing assigned tasks to study and seriously implement fully the provisions of law in construction activities, laws on bidding and other relevant laws; proactively prevent prolongation and accumulation into violations; strengthen discipline and order, clearly define the responsibility of the head in each stage of the construction activity process.
In the process of implementation, if problems arise, it is requested that ministries, ministerial-level agencies and People's Committees of provinces and cities send opinions to the Ministry of Construction for coordination and settlement according to their authority.
