How to register for land before July 1, 2025 but not yet resolved?
Pursuant to Clause 6, Article 22 of Decree 151/2025/ND-CP, the land registration dossier before July 1, 2025 but resolved by the competent authority shall be implemented as follows:
(1) In case under the authority of the Provincial People's Committee as prescribed by law before July 1, 2025, it will be resolved according to the procedures prescribed by the Land Law before the effective date of Decree 151/2025/ND-CP;
(2) In case it is under the authority of the People's Committee at the district level as prescribed by law before July 1, 2025, the Chairman of the People's Committee at the commune level will now handle it according to the procedures prescribed in Decree 151/2025/ND-CP.
Note, Decree 151/2025/ND-CP takes effect from July 1, 2025.
What are the principles of determining authority, decentralization, and delegation in the land sector?
Pursuant to Article 2 of Decree 151/2025/ND-CP, the principles of decentralization of authority, delegation of authority, and decentralization in the land sector are specifically stipulated as follows:
(1) Ensure compliance with the provisions of the Constitution; in accordance with the principles and regulations on the division of authority, decentralization and delegation of authority of the Law on Organization of the Government and the Law on Organization of Local Government.
(2) Ensure decentralization of tasks, thoroughly decentralize tasks between central state agencies and local governments, ensure the most open management rights of the Government, the executive rights of the head of the Government in the field of state management of land and promote the proactiveness, creativity, and self-responsibility of local governments in performing state management tasks in the land sector.
(3) Ensure the Government, the Prime Minister, ministries and ministerial-level agencies focus on implementing state management tasks at the macro level; develop institutions, strategies, plans, and synchronous and unified plans, play a role in creating and strengthening inspection, examination, and supervision.
(4) Ensure a clear division of authority between the People's Council, People's Committee, Chairman of the People's Committee; clearly define the general authority of the People's Committee and the separate authority of the Chairman of the People's Committee; ensure compliance with the tasks, powers and abilities of the competent authority of the agency or person performing the assigned tasks and powers.
(5) Ensure synchronization, comprehensiveness, connectivity, no omission or overlap or overlap of tasks; ensure a legal basis for the normal, continuous and smooth operation of agencies; meet local governance requirements; apply science, technology, innovation and digital transformation.
(6) Ensure human rights and civil rights; ensure publicity and transparency, create favorable conditions for organizations and individuals in accessing information, exercising rights, obligations and procedures according to the provisions of law.
(7) Ensure that it does not affect the implementation of international treaties and agreements to which the Socialist Republic of Vietnam is a member.
8. Resources for performing tasks are delegated and decentralized by the state budget according to regulations.
