In Clause 1, Article 18 of Decree 151/2025/ND-CP (effective from July 1, 2025), the Government stipulates: When submitting documents as prescribed in Clauses 3 and 4, Article 21 of Decree No. 101/2024/ND-CP, the registered candidate can choose one of the places to submit documents at the provincial level.
Previously, people or businesses were only allowed to submit documents to the competent land registration agency according to the administrative boundary where the land was located.
However, according to the new regulations, if the land registration procedures mentioned in Clause 3 and Clause 4, Article 21 of Decree 101/2024/ND-CP are carried out (including: registration of land use rights, registration of assets attached to land, issuance or updated Certificate...), the dossier submitter has the right to choose the place to receive the dossier at any unit in the same province/city...
Clause 3 and Clause 4, Article 21 of Decree 101/2024/ND-CP stipulate as follows:
(1) First registration of land and assets attached to land (Clause 3, Article 21 of Decree 101/2024/ND-CP)
- Domestic individuals, overseas Vietnamese who are Vietnamese citizens, communities: Submit documents to the One-stop Department according to the regulations of the Provincial People's Committee (including provincial, district, or commune levels).
- Domestic organizations, religious organizations, organizations with diplomatic functions, economic organizations with foreign investment capital, people of Vietnamese origin residing abroad: Selected to submit at:
One-stop Department, or
Land registration office.
(2) Registering changes in land and assets attached to land (Clause 4, Article 21, Decree 101/2024/ND-CP)
- Individuals and communities: You can choose to submit your application at:
One-stop Department (provincial/district/commune level),
Land registration office,
Branch of the Land Registration Office.
- Foreign organizations, individuals, economic organizations with foreign investment capital: Submitted to the One-stop Department or Land Registration Office.
- Receiving the transfer of land use rights and ownership of assets attached to land: Follow the choice of the receiving party and one of the above receiving locations.
Note: Scope of application: Limited to one province or centrally run city; not applicable to inter-provincial application submission.
The dossier receipt system must belong to the agencies specified by the provincial People's Committee as the place to receive the dossier and return the results of administrative procedure settlement.
