According to Point b, Clause 1, Article 38 of Decree 101/2024/ND-CP, when the issued Certificate is stained, blurred, torn, or damaged, people have the right to issue a new Certificate.
Application for issuance and renewal of Certificates
According to Clause 2, Article 38 of Decree 101/2024/ND-CP, the dossier submitted when carrying out procedures for granting and renewing Certificates includes:
- Application for registration of changes in land and assets attached to land according to Form No. 11/DK issued with this Decree
- Original Certificate of Land Use Rights.
Procedures for issuing and renewing Certificates
Prepare all documents, households and individuals will carry out the procedures for issuing and exchanging Certificates according to the following steps:
Step 1: Submit documents
- The place of submitting the application for a new Certificate is regulated as follows: Submit the application to the dossier receiving agency specified in Clause 1, Article 21 of this Decree.
Step 2: Receive documents
- The agency receiving the dossier, issuing the dossier receipt certificate and making an appointment to return the results to the land user and owner of the property attached to the land.
Step 3: Resolve requirements
- The Land Registration Office is responsible for performing the following tasks:
- Check the application, confirm the application for the reason for granting the Certificate.
- Prepare documents to submit to competent authorities for granting Certificates of land use rights, house ownership rights and other assets attached to land.
- Update and edit cadastral records and land databases; grant the Certificate to the granted person.
Implementation time
According to Clause 3, Article 22 of Decree 101/2024/ND-CP, the time to carry out the procedures for granting and renewing Certificates is as follows:
- No more than 5 days from the date of receipt of valid documents; no more than 15 days for mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions.
- This time does not include holidays and days off as prescribed by law; does not include time for receiving documents at the commune, time for fulfilling financial obligations of land users; does not include time for considering and handling cases of land use that violate the law, time for requesting appraisal.
Fees for issuing and exchanging Certificates
- The fee for issuing and exchanging Certificates is regulated by the Provincial People's Council, so each locality has a different collection rate (receive rate under 100,000 VND).
