Documents when applying for land division
Below are the types of documents that land users must prepare when applying for land division:
- Red book (original, or notarized, certified copy).
- Application for land division according to Form No. 01/DK issued with Decree 101/2024/ND-CP.
- drawings of land division according to Form No. 02/DK issued with Decree 101/2024/ND-CP are made by: Land Registration Office, Branch of Land Registration Office; The measuring unit has a license for measurement activities, and establish a cadastral map.
- Documents of competent authorities showing the content of land division (if any).
Place to receive documents for land division
The application for land division can be submitted to the following agencies:
- The One-stop Department according to the regulations of the Provincial People's Committee (PPC) on receiving documents and returning results of handling administrative procedures at the provincial and commune levels.
- Land registration office.
- Branch of the Land Registration Office.
Time to handle land division procedures
According to Clauses 4 and 10, Article 22 of Decree 101/2024/ND-CP, the deadline for implementing procedures for land division and land consolidation is as follows:
- No more than 15 working days.
- For mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions, the time for land division and consolidation will be increased by 10 working days.
