Pursuant to Section 8, Sub-section A, Section I, Part II, Administrative procedures issued with Decision 3380/QD-BNNMT in 2025 stipulate the procedures for granting and exchanging Land Use Rights and Property Ownership Rights attached to land from August 25, 2025 at the provincial level as follows:
(1) The person requesting registration submits the application to one of the following locations in the provincial level: Public Administration Service Center or Land Registration Office or Branch of the Land Registration Office.
When submitting the prescribed documents, the registration fee is selected to submit a copy of the document and present the original for the officer receiving the application to check the comparison or submit the original of the document or submit a notarized or certified copy of the document according to the provisions of the law on notarization and certification; in case of submitting the application online, the submitted document must be digitized from the original or the certified and certified copy of the document.
In case of submitting a copy or digital copy of all documents, when receiving the results of handling administrative procedures, the registered candidate must submit the original documents in the dossier components according to regulations.
(2) The dossier receiving agency shall:
- Check the completeness of the dossier components and issue a dossier receipt and schedule a return of results.
In case the documents are not complete, the documents must be returned with the Supplement and Complete Application Form so that the applicant can register to complete and supplement according to regulations.
- In case the Public Administration Service Center receives the dossier, the dossier shall be transferred to the Land Registration Office or Branch of the Land Registration Office.
(3) The Land Registration Office, Branch of the Land Registration Office shall:
- In the case of issuing and exchanging the Certificate of land use rights and ownership of assets attached to land to record the full name, wife's name and husband's name, exploit and use information about the marital status in the National Population Database.
In case information about the marital status cannot be exploited, the land user or owner of the property attached to the land must submit a copy of the marriage certificate or other documents on the marital status.
- In case the location of the land plot on the issued Certificate is not accurate compared to the actual location of land use at the time of issuance of the Certificate, conduct a field inspection and compare with the registration dossier, issue the issued Certificate to determine the correct location of the land plot.
- Check and approve the cadastral map extract in cases where the land user has a need to re-determine the size of the edges and area of the land plot.
- Record a cadastral map or extract a cadastral map of a land plot for places without a cadastral map or only a cadastral map in the form of a torn or damaged document in cases where the issued Certificate has not used a cadastral map or has not used a cadastral map extract for a land plot and the land user needs to reissue a new Certificate of land use rights, ownership of assets attached to land or is required to reissue a new Certificate of land use rights, ownership of assets attached to land.
- send the Information Transfer Form to determine financial obligations on land according to Form No. 19 issued with Decree 151/2025/ND-CP amended and supplemented by Decree 226/2025/ND-CP to the tax authority to determine and notify the collection of financial obligations in cases where financial obligations must be fulfilled according to the provisions of law.
- Adjust and update changes in cadastral records and land databases.
- Issued a Certificate; issued a Certificate or sent to the dossier receiving agency to be presented to the person granted.
In case of issuing and exchanging the issued Certificate due to cadastral survey and making a map, the mortgagor holding the Certificate shall notify the mortgagee of the list of cases that undergo the procedures for issuing a Certificate; confirm the mortgage registration on the issued Certificate. The granting of Certificates is done simultaneously between three parties including the Land Registration Office, Branch of the Land Registration Office, Land user, owner of assets attached to land and mortgagee; land user, owner of assets attached to land signs and receives a new Certificate from the Land Registration Office, Branch of the Land Registration Office to hand over to the mortgagee; mortgagee is responsible for submitting the old Certificate in mortgage to the Land Registration Office, Branch of the Land Registration Office for management.
