Decision 3380/QD-BNNMT dated August 25, 2025 of the Ministry of Agriculture and Environment stipulates the registration of changes in land use rights and ownership of assets attached to land due to division, separation, consolidation, merger of organizations or conversion of organizational models, conversion of business types according to the provisions of the law on enterprises; adjustment of detailed construction planning; granting Certificates for each plot of land according to detailed construction planning to project investors in need.
Components and quantity of documents
- Document composition
a) In case of change of land use rights, ownership rights of assets attached to land due to division, separation, consolidation, merger of organizations or conversion of organizational models, conversion of business types according to the provisions of the law on enterprises:
- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree No. 151/2025/ND-CP.
- issued certificate.
- Business registration certificate or document on the establishment of the organization after change.
- Decision of competent authority or organization or document on division, separation, consolidation, merger, conversion of organizational models, conversion of business types in accordance with the provisions of law on enterprises in accordance with the provisions of law, in which it is necessary to clearly identify the organization that is allowed to use land, own assets attached to land after division, separation, consolidation, merger, conversion of organizational models, conversion of business types.
- drawings for land division and consolidation according to Form No. 22 issued with Decree No. 151/2025/ND-CP in cases where land division and consolidation are required.
- Land plot cadastral map extracts for cases where land users need to measure to re-determine the size of the edges and area of the land plot.
- Documents on representation according to the provisions of civil law in cases of carrying out procedures for registration of land and assets attached to land through representatives.
b) In case of adjustment of detailed construction planning:
- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree No. 151/2025/ND-CP.
- issued certificate.
- Decision approving adjustment of detailed construction planning by competent authority accompanied by detailed construction planning adjustment map and cadastral map or cadastral map measurement piece; in case the land price must be re-determined, additional documents must be submitted proving fulfillment of financial obligations on land.
- Documents on representation according to the provisions of civil law in cases of carrying out procedures for registration of land and assets attached to land through representatives.
c) In the case of granting a Certificate for each plot of land according to the detailed construction planning to the project investor in need:
- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree No. 151/2025/ND-CP.
- issued certificate.
- The decision approving the detailed construction planning of the competent authority together with the detailed construction planning map and cadastral map or cadastral map measurement piece.
- Documents on representation according to the provisions of civil law in cases of carrying out procedures for registration of land and assets attached to land through representatives.
- Number of documents: 01 set.
Scope of settlement
- The time to resolve procedures for changing land use rights and ownership of assets attached to land due to division, separation, consolidation, merger, conversion of organizational models, and conversion of business types shall not exceed 08 working days.
For mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions, the implementation period shall not exceed 18 working days.
- The time to resolve procedures for granting Certificates of land use rights and ownership of assets attached to land according to detailed construction planning or adjusting detailed construction planning is no more than 05 working days.
For mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions, the implementation period shall not exceed 15 working days.
