On October 30, Cao Bang Provincial People's Council held the 24th Session (special session) of the 17th Provincial People's Council, term 2021 - 2026.
The meeting listened to presentations and inspection reports of the provincial People's Council committees on draft resolutions on deciding principles, scope, support levels and use of funds to support the protection of rice-growing land in the province; stipulating expenditure levels to ensure the organization of compensation, support and resettlement in the province.
Regulations on preferential land rent exemption for projects using land for production and business purposes in investment incentive sectors and occupations and meeting the conditions of type, scale criteria, and socialization standards decided by the Prime Minister or non-profit projects.
Report No. 2894/TTr-UBND dated October 28, requesting opinions on regulations on percentage (%) for calculating land rental price, land rental price for underground construction, land rental price for land area with water surface in the area.
Cao Bang Provincial People's Council has agreed on the percentage to calculate land rental price, land rental price for underground construction, land rental price for land area with water surface in the province submitted by the Provincial People's Committee.
Accordingly, the percentage to calculate the land rental price for the case of land rental with annual payment without auction in Hop Giang ward (Cao Bang city) is 2%, for the remaining wards and communes it is 1.5%. In the remaining districts in the province, the land rental price in the town is 1.5%, the remaining communes is 1%.
The land rental price for underground construction as prescribed in Clause 1, Article 120 of the Land Law will be calculated as follows: In case of land rental with annual land rental payment, the land rental price is calculated at 30% of the surface land rental price in the form of land rental with annual land rental payment for the same land use purpose.
In case of land lease with one-time land rent payment for the entire lease term, the land rent unit price is calculated at 30% of the surface land rent unit price for the form of land lease with one-time land rent payment for the entire lease term with the same purpose of use and land use term.
For the land area with water surface, the land rental price with annual land rental payment, the land rental price with one-time land rental payment for the entire rental period is calculated at 50% of the annual land rental price or the land rental price with one-time land rental payment for the entire rental period of the adjacent land type assuming the same land use purpose and land use term as the land area with water surface.
