The Department of Natural Resources and Environment of Khanh Hoa province has provided information to the provincial Tax Department to supplement information related to the Le Hong Phong II New Urban Area project (Nha Trang city).
Over the past 10 years, more than 1,200 households who bought land at the Le Hong Phong II project have continuously submitted complaints because the investor cannot issue land use right certificates.
There are many reasons why it is difficult to issue a "red book" for this project.
In particular, Khanh Hoa province has adjusted the detailed construction planning many times (6 times) and had to adjust land procedures 6 times according to the detailed construction planning. Not only that, this project has adjusted the planning and land procedures many times but still has not been regulated on land prices to fulfill financial obligations.
Most recently in August, Khanh Hoa province approved land prices for four real estate projects, including the Le Hong Phong II project.
However, the locality quickly canceled 4 decisions approving land prices for the above real estate projects and at the same time, rebuilt the land price calculation plan to suit reality.
In a recent official dispatch of the Tax Department, the Department of Natural Resources and Environment of Khanh Hoa province has added information on the area of each type of land to determine land use fees for the Le Hong Phong II New Urban Area project according to Decision No. 1608 of 2015 of the People's Committee of Khanh Hoa province.
Regarding the land rental price for annual land rental payment, based on Decision No. 1608, Decision No. 2282 dated August 29, 2024 of Khanh Hoa Provincial People's Committee, the specific land price for calculating land rental payment for annual land rental payment for construction of multi-functional service works is 6,416,565 VND/m2.
Accordingly, land rent is stabilized for a 5-year cycle from June 19, 2015 to June 18, 2021. From June 19, 2021, the unit price for calculating stable land rent for the next cycle must be re-determined.
According to the Department of Natural Resources and Environment of Khanh Hoa province, the Le Hong Phong II New Urban Area project of Ha Quang Real Estate Joint Stock Company is subject to transitional handling according to the provisions of Decree 103 dated July 30, 2024 of the Government.
