Pursuant to Clause 2, Article 118 of Decree 175/2024/ND-CP:
Article 118. Revoking construction permits
1. Foreign contractors have their construction permit revoked in one of the following cases:
a) Forgery of documents in the application for a construction permit;
b) Repairing or erasing the content of the construction operation license;
c) The construction operation license is recorded incorrectly due to an error by the construction operation license issuing agency.
2. Authority to revoke construction permits:
a) The competent authority issuing the construction operation license is the competent authority to revoke the construction operation license granted by it;
b) In case the construction operation license is issued incorrectly and the competent authority issuing the license does not revoke it, the Ministry of Construction will directly decide to revoke the construction operation license.
However, according to Point c, Clause 3, Article 10 of Decree 144/2025/ND-CP effective from July 1, 2025:

c) The authority to revoke construction operation licenses for foreign contractors is prescribed in Point b, Clause 2, Article 118 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government, implemented by the Provincial People's Committee.
The procedure for revoking construction permits for foreign contractors is implemented according to the provisions of Clause 3, Article 118 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government.
Accordingly, from July 1, 2025, the Provincial People's Committee will have the authority to revoke the construction operation license of foreign contractors in case the license is granted incorrectly and the issuing agency does not revoke it.
