Pursuant to the provisions of Clause 2, Article 107 of the 2014 Construction Law, the groundbreaking of individual housing construction only requires meeting the conditions specified in Point b, Clause 1, Article 107 of the 2014 Construction Law, amended by Clause 39, Article 1 of the 2020 amended Construction Law:
In addition, the groundbreaking of the project must ensure the following conditions:
- Have a construction site to hand over the entire or part according to the construction progress.
- Having a construction permit for a construction work requires a construction permit according to the provisions of Article 89 of the 2014 Construction Law.
- There are approved construction drawing designs for construction items and works.
- The investor has signed a contract with the contractor to carry out construction activities related to the project that has been started in accordance with the provisions of law.
- Take measures to ensure safety and protect the environment during construction.
- The investor has sent a notice of the construction start date to the local state management agency for construction at least 3 working days before the start of construction.
According to the principle, all construction works and houses must be granted a construction permit before starting construction, except in cases of exemption according to regulations.
Pursuant to the provisions of Article 66 of Decree 175/2024/ND-CP:
Article 66. Public construction permit
1. The construction licensing agency is responsible for publicly announcing the content of the construction permit that has been granted on its website.
2. The investor is responsible for publicizing the content of the construction permit issued at the construction site throughout the construction process for organizations and individuals to monitor and supervise in accordance with relevant legal regulations.

- The construction licensing agency is responsible for publicly announcing the content of the construction permit issued on its electronic information page.
- The investor is responsible for publicizing the content of the construction permit issued at the construction site throughout the construction process for organizations and individuals to monitor and supervise in accordance with relevant legal regulations.
