On the Government Portal on September 1, Mr. D.T in Hanoi said that he was carrying out construction licensing work at the People's Committee of the commune.
In the commune, there are a number of investment projects to build technical infrastructure for auctioning land use rights with detailed plans at a scale of 1/500 or in areas with detailed plans for the commune center and rural residential areas at a scale of 1/500.
The project only invests in construction of traffic, leveling, water supply, drainage, lighting, ... not investing in construction of houses on land and people won the auction for land use rights to build by themselves.
The detailed planning includes architectural planning indicators such as the number of floors, construction density, floor plan 1, land use coefficient, etc. )
According to the Department of Construction, the commune with the above detailed 1/500 planning is not exempted from a construction permit, but must be a project under a construction investment project that has been appraised by a specialized construction agency and a feasibility study report for construction in an area with a detailed 1/500 planning or urban design approved by a competent authority.
Mr. T asked, is that correct?
The Ministry of Construction responds to this issue as follows:
According to current law, for residential area projects with the goal of investing in infrastructure construction and transferring land to households and individuals to build their own houses, with a detailed 1/500 plan approved by a competent state agency, when people receive land transfer and build their own houses not subject to the provisions of the 2025 Railway Law, people must carry out construction licensing procedures before starting construction.
I suggest that you study and ensure compliance with current legal regulations.
