The Ministry of Construction has just responded to a petition from voters in Ho Chi Minh City regarding the issuance of construction permits.

The Ministry of Construction has Official Dispatch No. 12567/BXD-KTQLXD sent to the Committee for Petitions and Supervision of the National Assembly, the Delegation of National Assembly Deputies of Ho Chi Minh City to respond to the recommendations of Ho Chi Minh City voters sent after the First Session, 16th National Assembly.

According to the proposed content, currently, some regulations related to construction permit issuance still have overlaps between the Construction Law, 2024 Land Law, Planning Law and other specialized regulations, leading to complicated administrative procedures, prolonged dossier processing time, causing difficulties for people and businesses.

Many cases require implementation through many agencies, supplementing dossiers many times or waiting for inter-sectoral opinions, thus increasing costs and affecting investment and construction progress. Therefore, voters proposed that the Ministry of Construction take the lead in coordinating with relevant ministries and sectors to review, amend and unify relevant legal regulations in a synchronous and clear direction, reduce intermediate procedures, and promote the application of digital technology in dossier resolution to facilitate people, improve the efficiency of state management and improve the investment and business environment.

After researching, the Ministry of Construction answers this question as follows:

On December 10, 2025, the National Assembly passed Construction Law No. 135/2025/QH15. The Government has issued Decrees detailing and guiding the implementation of Construction Law No. 135/2025/QH15, including Decree No. 217/2026/ND-CP dated June 19, 2026 and Decree No. 212/2026/ND-CP dated June 17, 2026 (the decrees take effect from July 1, 2026, concurrently with the effectiveness of Construction Law No. 135/2025/QH15). In which, Decree No. 217/2026/ND-CP has specifically stipulated the order and content of considering the issuance, adjustment, re-issuance, and extension of construction permits. The procedures for applying for permits are regulated to be carried out in an electronic environment to promote the application of science and technology. At the same time, the authority and time for issuing construction permits are also clearly stipulated, avoiding overlap and causing difficulties for people and businesses.

Decree No. 212/2026/ND-CP stipulates that urban and rural planning data is part of the national database on construction activities. At the same time, the Decree also stipulates the sharing of land data to serve the management of construction investment activities.

Therefore, synchronous and complete data connection on the national database system and specialized database system will help promote the application of digital technology in resolving dossiers, reducing intermediate procedures to facilitate people, improve state management efficiency and improve the investment and business environment.

The Ministry of Construction respectfully sends the Delegation of National Assembly Deputies of Ho Chi Minh City to inform voters; sends to the Committee for Petitions and Supervision of the National Assembly to summarize, monitor, and supervise according to regulations.
