The Ho Chi Minh City Real Estate Association (HoREA) has sent a document to the Prime Minister, the Ministry of Natural Resources and Environment, and the Ho Chi Minh City People's Committee to give comments on the method of calculating the adjusted land price list in Ho Chi Minh City.
In particular, in terms of policy mechanisms, Mr. Le Hoang Chau - Chairman of HoREA proposed that the land price levels of the draft adjusted land price list should ensure fairness for individuals and households paying land use fees after July 31, 2024, which will be equivalent, or if higher, not too different from cases that have paid land use fees in the first 7 months of 2024 according to the 2024 land price adjustment coefficient prescribed in Decision 56/2023/QD-UBND.
Mr. Le Hoang Chau proposed using the method of calculating the adjusted land price table by taking the actual compensation price at the routes approved by the Ho Chi Minh City People's Committee as the standard and applying the comparison method to determine the land price of neighboring routes in the same area or between areas in each district, county, and Thu Duc city.
This is to ensure fairness for individuals and households who will pay land use fees from August 1, 2024 to December 31, 2025. They will also pay the same amount or, if higher, not too much different from cases that paid land use fees in the first 7 months of 2024.
In addition, HoREA recommends not using the method of calculating the adjusted land price table by taking land price table 02 (Decision No. 02/2020/QD-UBND dated January 16, 2020) multiplied by the coefficient to calculate all land prices in the draft adjusted land price table as in the case of the draft adjusted land price table of District 1, District 4 and District 5. At the same time, HoREA recommends rebuilding the draft adjusted land price table of these districts.
HoREA also recommended not to use the method of calculating the adjusted land price table by taking the land price table 02 multiplied by the coefficient to calculate uniformly for each group of routes in the draft adjusted land price table such as District 10, Phu Nhuan District and recommended to rebuild the draft adjusted land price table of these districts.
In addition, according to HoREA's proposal, the land prices of the draft adjusted land price list in 6 districts (including Districts 3, 6, 7, 11, 12, Binh Thanh), 4 districts (including Hoc Mon, Cu Chi, Binh Chanh, Can Gio) and Thu Duc City are not built with the highest land price in the draft adjusted land price list higher than the highest level of the coefficient frame (K) for residential land according to Decision 11/2024/QD-UBND.
As reported by Lao Dong Newspaper, since August 1, many real estate transfer and land use purpose change files of people in Ho Chi Minh City have been "suspended" when transferred to the tax authority for tax calculation and land use fee calculation, causing many problems for people. The Ho Chi Minh City Tax Department has also sent two official dispatches to the Ho Chi Minh City People's Committee, stating the shortcomings and difficulties in the process of handling the files at the tax authority.
The Ho Chi Minh City People's Committee has also sent a document asking for the Prime Minister's opinion on guiding the calculation of land financial obligations for records arising after August 1 until the adjusted land price list is available. According to the Ho Chi Minh City People's Committee, the city is facing difficulties and obstacles in resolving administrative procedures on financial obligations in the transition period from August 1, 2024 until the time the adjusted land price list according to the provisions of Clause 1, Article 257 of the 2024 Land Law is issued.
Accordingly, from August 1, 2024, if the unadjusted land price table in Decision No. 02/2020 is applied without multiplying by the 2024 land price adjustment coefficient, it will not be suitable for the current actual land price conditions in the locality. If the unadjusted land price table in Decision No. 02 is continued to be applied multiplied by the 2024 land price adjustment coefficient, there will be no regulations guiding its implementation.
