According to the Department of Natural Resources and Environment of Ho Chi Minh City (DONRE), regarding the adjustment of land price list , in addition to organizing to collect opinions according to the shortened procedures of the law on drafting normative documents (announcing and collecting opinions within 7 days), Ho Chi Minh City has conducted 4 additional conferences to collect opinions.
Regarding the roadmap for adjusting the new land price list and considering land prices in some areas with limited infrastructure, economic and social conditions, the Department of Natural Resources and Environment said that according to the provisions of the 2024 Land Law, the roadmap for adjusting the land price list includes 3 stages.
From August 1, 2024 to December 31, 2025, the land price list will be adjusted to suit the actual situation of land prices in the city according to the provisions of Clause 1, Article 257 of the 2024 Land Law.
Determine the level, complexity and impact of land price list in the city, as the agency in charge of advising and drafting documents under the direction of the City People's Committee.
The adjusted land price list is implemented in accordance with the procedures prescribed in Article 17 of Decree No. 71/2024/ND-CP of the Government. The authority to adjust the land price list during this period belongs to the City People's Committee according to the provisions of Clause 1, Article 257 of the 2024 Land Law and Clause 6, Article 17 of Decree No. 71/2024/ND-CP of the Government.
According to the Department of Natural Resources and Environment, in principle, land prices in the land price list must reflect the actual common land prices on the market under normal conditions according to the Party's policy in Resolution No. 18-NQ/TW and the provisions of the 2024 Land Law.
The collection level and collection rate for this obligation will be stipulated in documents issued by the Central agency. The Department of Natural Resources and Environment has advised the City People's Committee to report and recommend the Prime Minister to consider and approve the assignment of relevant ministries and branches to advise, develop and promulgate policies regulating the collection level and collection rate appropriately when the land price list has been adjusted to suit the actual situation of land prices in the locality.
Reasonable collection level ensures people's rights
According to the Department of Natural Resources and Environment, the proposed adjusted price list will overcome the situation of two prices, regulate the "land rent difference", ensure fairness and harmony of interests between land users, investors and the state. For example, the Ring Road 3 project arranges resettlement on Road No. 1 in the Phuoc Thien resettlement area with a resettlement price of 51 million VND/m2. Thus, updating the above price, people who are arranged for resettlement or people who change the land use purpose on this route must apply according to the price list to ensure fairness.
The Department of Natural Resources and Environment believes that land prices in the adjusted land price list do not affect the "specific land valuation" to calculate land use fees and land rents for real estate and commercial housing projects because these projects are calculated using the surplus method.
Furthermore, agricultural land prices have been adjusted to match reality, so investors' deductions will be more appropriate than before. Thereby, contributing to improving the business and investment environment in the city, while adjusting the selling prices of real estate products more appropriately, creating conditions for those in need to access.
Key projects and works invested with State budget capital will be implemented on schedule without any congestion.
