The Department of Natural Resources and Environment of Ho Chi Minh City has just reported to the Ministry of Natural Resources and Environment on how to adjust the land price list according to the 2024 Land Law to suit the actual situation of land prices in Ho Chi Minh City .
According to the Department of Natural Resources and Environment of Ho Chi Minh City, Clause 1, Article 257 of the 2024 Land Law allows the Provincial People's Committee, if necessary, to decide to adjust the land price list to suit the actual situation of land prices in the locality.
At the same time, the Standing Committee of the Ho Chi Minh City Party Committee has chosen the option of developing an adjusted land price list applicable for the period from August 1, 2024 to December 31, 2025 in Ho Chi Minh City.
Ho Chi Minh City bases on the existing land price database filtered from sources such as compensation land prices, resettlement land prices, prices approved by People's Committees at all levels, actual land transfer prices from land registration agencies and tax agencies to update and adjust the land price list.
According to the Department of Natural Resources and Environment of Ho Chi Minh City, the plan complies with the provisions of Clause 1, Article 257 of the 2024 Land Law and is consistent with the actual situation of land prices in Ho Chi Minh City. Therefore, the City People's Committee has decided to assign the Department of Natural Resources and Environment to develop a decision to adjust Decision No. 02/2020/QD-UBND dated January 16, 2020 of the City People's Committee regulating land prices in Ho Chi Minh City.
The Department of Natural Resources and Environment of Ho Chi Minh City also reported on the procedures and methods for building the adjusted land price list through 6 steps. Currently, the department is in the final step.
Previously, when informing the press in Ho Chi Minh City about the implementation of the adjusted land price list, the Department of Natural Resources and Environment expressed the view that the adjusted price list will overcome the situation of two prices, regulate the "land rent difference", and ensure fairness and harmony of interests between land users, investors and the state.
The Department of Natural Resources and Environment also acknowledged that the proposed adjusted land price list will affect financial obligations when households and individuals change the purpose of use within the residential land limit. The area outside the limit has always had to be determined at market price. However, this is fair because in the case of people having their land recovered, they will also be compensated at market price.
Regarding the reflection of people in the suburbs of Ho Chi Minh City about facing difficulties when land prices increase, causing the collection level and collection rate to increase accordingly when needing to change the land purpose to build a house or for children, the Department of Natural Resources and Environment said that the adjusted land price list must closely follow the market price and has the role of a price list, while the collection level and collection rate are regulated by the Government.
Therefore, the Department will report to the City People's Committee to propose the Government to consider and adjust to suit the current socio-economic situation.
In case people do not have money to pay land use fees, the Land Law allows debt. Poor households and policy families have exemptions and reductions in land use fees and land rents.
