Is it necessary to notarize temporary residence registration for student tenants?
Pursuant to the provisions of Clause 3, Article 13 of Circular 55/2021/TT-BCA, supplemented by Clause 7, Article 1 of Circular 66/2023/TT-BCA on temporary residence registration as follows:
- Students, trainees who come to live in dormitories, housing areas of students, students, and trainees; workers who come to live in workers' housing areas; children, people with disabilities, and people without a home are adopted and live in religious establishments and religious establishments; people who are cared for, nurtured, or assisted at social assistance facilities can register for temporary residence through the agency or organization directly managing that place.
The agency or organization directly managing the agency is responsible for making a list of temporary residents, attaching the Declaration of change of residence information of each person, the document requesting temporary residence registration, which clearly states information about legal residence and the agency registering the residence updates information about the temporary residence in the Residence Database. The list includes basic information for each person: full name, spelling and name; date, month, year of birth; gender; personal identification number and temporary residence period.
- In case the documents and papers proving legal residence for temporary residence registration are documents for leasing, lending, or renting a house or other property of an individual or organization, those documents do not require notarization or certification.
Accordingly, documents and papers proving legal residence to register for temporary residence for students renting a room do not require notarization or certification.
What documents and papers prove legal residence to register for temporary residence?
Pursuant to the provisions of Clause 3, Article 5 of Decree 154/2024/ND-CP on documents and papers proving legal residence to register for temporary residence, one of the following documents and papers:
- One of the documents and papers specified in Clause 2, Article 5 of Decree 154/2024/ND-CP, except in cases where documents and papers proving legal residence are documents for lease, lending, or letting for legal residence by agencies, organizations, or individuals, that document must not be notarized or certified.
- A commitment from a citizen to have a place to live under his/her right to use, without a dispute over the right to use and to have a stable, long-term living there if he/she does not have one of the documents or papers specified in Point a of this Clause. The content of the commitment document includes: full name, letters and name; date, month, year of birth; personal identification number; place of residence; information on the place of residence proposed for temporary residence registration and the commitment of the citizen.
- Documents and papers of the owner of a tourist accommodation establishment or other establishment with a stay function allowing the individual to register for temporary residence at that establishment.
- Documents of the agency or organization managing the industrial park, processing zone, or economic zone allowing employees to register for temporary residence at the place of residence under their ownership or management in accordance with the provisions of law.
- Documents of the agency or organization managing works, construction sites, dormitories, craft villages, establishments, and production and business organizations allowing employees to register for temporary residence at the place of residence under their ownership or management in accordance with the provisions of law.
