In March 2022, the family of Ms. Phung Thi Phuong Mai (born in 1978, residing in Quarter 4, Ward 1, Dong Ha City, Quang Tri Province) purchased a plot of land with a land use right certificate (red book) No. 84, map sheet No. 18 in Quarter 5 (Ward 3, Dong Ha City, Quang Tri Province). The plot of land has an area of 181.0m2, issued by the Department of Natural Resources and Environment of Quang Tri Province on January 27, 2021.
After buying the land, Ms. Mai applied for a construction permit to build a house. Then, the Quang Tri Province Land Registration Office, Dong Ha City Branch, came to measure and discovered that there was a part of the house of Ms. M.T.T.H's family next door on the land.
Ms. Mai sent a petition to the People's Committee of Ward 3, requesting a settlement, but the mediation was unsuccessful, so in June 2023, she sent a petition to the People's Court of Dong Ha City. After nearly a year, the People's Court of Dong Ha City has not brought the case to trial, then transferred the file to the People's Court of Quang Tri Province.
According to the current land status map requested by the Dong Ha City People's Court and the Quang Tri Province People's Court to be measured by the Quang Tri Province Land Registration Office, Dong Ha City Branch, the house of Ms. M.T.T.H's family encroached on the land area granted to Ms. Mai by about 23 square meters. The encroached area is more than 12 meters long, and about 3 meters wide at its widest point, causing Ms. Mai's land plot to be deformed.
"More than a year has passed, but the issue of my family's land being encroached upon and deformed has not been resolved. I want to return the land to its original state as stated in the red book, so that I can build a house and stabilize my life" - Ms. Mai wishes.
Investigation shows that in 2006, Ms. M.T.T.H's family received a transfer of the land plot and was granted a red book with plot number 29a, map sheet number 18 with an area of 250m2. By 2019, Ms. M.T.T.H's family built a solid house, with a construction permit issued by the People's Committee of Dong Ha city.
In the permit, the project was only built on an area of 250m2 as the red book granted, but in reality, the project was built on an area of over 300m2. Of the construction area outside the red book granted, a part of the land is in Ms. Mai's red book, a part is state land, under the management of Quang Tri Pedagogical College.
According to the People's Committee of Dong Ha City, on September 5, 2024, the unit assigned the City Construction Order Team to preside over and coordinate with the City Urban Management Department and Ward 3 People's Committee to inspect the construction of Ms. M.T.T.H's family's house according to Ms. Mai's petition. As for Ms. Mai's complaint sent to the units, the People's Court of Quang Tri province is currently handling and resolving it.
