On the Government Portal, Mr. H.P in Tay Ninh has 1 red book for a 600 m2 garden land and 1 red book for a 100 m2 rural residential land.
The rural land plot is located in a garden land plot according to the cadastral map, but 2 red books have been issued.
Now Mr. P wants to convert the land use purpose of an additional 50 m2 of garden land (agricultural land) to rural residential land adjacent to the allocated rural residential land plot. So does he have to carry out land separation procedures?
The Ministry of Agriculture and Environment answers this question as follows:
Resolution No. 254/2025/QH15 dated December 11, 2025 of the National Assembly stipulates a number of mechanisms and policies to remove difficulties and obstacles in the organization of the implementation of the Land Law, effective from January 1, 2026.
Clause 3, Article 11 of this Resolution stipulates that in case of changing the land use purpose of a part of a land plot, land separation is not mandatory.
It is requested that he study the regulations and contact competent authorities for consideration and resolution.
