Conditions for separating red books for children in 2026
According to the provisions of the 2024 Land Law, parents are allowed to separate the red book to give to their children when the land plot meets the following conditions:
Having a Certificate of Land Use Rights (red book or pink book); land with validity; no disputes, complaints; not being seized to enforce judgments or apply temporary seizure measures.
In case the land plot is in dispute but the scope and boundary of the dispute has been clearly defined, the uncontested area will still be considered for division according to regulations.
The land plot after separation must ensure a path, connection to public transport routes and meet the conditions for water supply, drainage, and essential infrastructure.
The area and size of the land plot after division must meet the minimum level prescribed by the People's Committee of the province where the land is located. People need to carefully understand local regulations before carrying out procedures.
How are the procedures for separating children's red books carried out?
Land users submit the land division dossier to the People's Committee of the commune where the land is located, the Land Registration Office or the Branch of the Land Registration Office. In addition, the application can be submitted online through the National Public Service Portal.
After receiving the application, the competent authority checks the validity of the application and compares the conditions for land division. In case the documents are not eligible, the competent authority will return them and clearly state the reason. If the documents are valid, the specialized agency will confirm that the conditions for dividing the plots are met, complete the drawings and carry out registration, and issue red books for new plots of land.
After completing the separation of the red book, parents carry out the procedures to donate land use rights to their children according to the law.
Time to resolve land division
The time to handle the procedure for separating the child's red book must not exceed 15 working days from the date of receiving a complete and valid dossier. For mountainous communes, islands, remote areas or areas with difficult socio-economic conditions, the settlement time is extended by 10 working days.
