Citizen D.T.V.H asked: My house before 1982 had a level 4 house for living, the land was decided to be licensed by the 2nd Army officer School.
Up to now, the house has deteriorated, my family wants to rebuild a new level 4 house with a total area of 80 m2.
So, can I apply for a construction permit to build a level 4 house? What are the administrative procedures? and whether to pay the cost to get a license or if there is a red book, a construction permit will be granted?
After studying, the Department of Economics - Construction Investment Management, Ministry of Construction gave the following opinion:
General regulations on granting construction permits are stipulated in Article 89 of the 2014 Construction Law (amended and supplemented in Clause 30, Article 1 of Law No. 62/2020/QH14).
In which, the cases of exemption from construction permits are stipulated in Clause 2 of this Article.
The application for a construction permit for new construction (if any) is stipulated in Article 55 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government.
The cost of granting a construction permit is implemented in accordance with the provisions of current laws on finance and land.
