Conditions for rice growing land to be compensated when recovered
In order to receive compensation, recovered rice land must meet the following conditions:
+ The land being used is not leased land with annual rental payments.
+ Have a Certificate of land use rights, Certificate of house ownership and residential land use rights, Certificate of land use rights, ownership of houses and other assets attached to land or meet all conditions to be granted a Certificate of land use rights, ownership of houses and other assets attached to land.
+ Land users are eligible for compensation;
+ Compensation in the form of land with the same use purpose as the recovered land.
Latest compensation price for rice growing land
Compensation for land and rice when recovered depends on each case.
If land is recovered to serve economic and social development or for national and public interests, the State will compensate with land of the same use purpose. If there is no land fund for compensation, compensation will be made in money according to the specific land price to the land user.
If the recovered land plot does not qualify for land compensation, only the remaining land investment costs will be compensated.
Pursuant to Article 114 of the 2013 Land Law, in case of receiving compensation corresponding to the area of rice land recovered, the price to calculate compensation is the specific land price.
Accordingly, the compensation price for agricultural land will be based on the land price list issued by the Provincial People's Committee (People's Committee).
Currently, the maximum amount of money to support people's actual investment costs up to the time of land recovery, calculated in cash, is no more than 3,000 VND/m2.
Additional money people can receive when rice land is recovered
According to the provisions of Clause 2, Article 83 of the 2013 Land Law, in addition to compensation in land or money when land is recovered, people whose rice land is recovered can also be considered for other supports such as:
+ Support to stabilize life and production
+ Support for training, career change and job search.
+ Other support (depending on the conditions of each province or city).
