1. Authority to regulate land allocation limits for each household
Land allocation is the State's issuance of a land allocation decision for the purpose of granting land use rights to people in need of land use. The 2024 Land Law stipulates the authority to decide on land allocation limits for each household as follows:
- Rural residential land: The provincial People's Committee shall prescribe the limit for allocating residential land to individuals in rural areas for housing and other purposes for living on the same plot of land depending on the land fund and the actual situation in the locality (Article 195).
- Urban residential land: The provincial People's Committee shall prescribe the limit for allocating residential land to individuals in urban areas for housing and other purposes for living on the same plot of land depending on the land fund and the actual situation in the locality (Article 196).
- Agricultural land: The provincial People's Committee stipulates the limit for allocating agricultural land to households for use according to the planning and land use plan approved by the competent authority (Clause 5, Article 176).
2. Latest limit for land allocation to households
2.1 Limit of land allocation to rural households
Residential land managed and used by households in rural areas includes: Land for building houses and constructing works serving life to ensure compliance with land use planning and residential area construction planning in rural areas approved by competent authorities.
Pursuant to the provisions of Clause 2, Article 195 of the 2024 Land Law, the provincial People's Committee shall rely on local land funds and rural socio-economic development plans approved by competent authorities to regulate land allocation limits for each household to build houses in rural areas.
2.2 Limit of land allocation to households in urban areas
Residential land managed and used by households in rural areas includes: Land for building houses and constructing works serving life to ensure compliance with land use planning and urban residential area construction planning approved by competent authorities.
Pursuant to Clause 2, Article 195 of the 2024 Land Law, the People's Committee at the provincial level shall rely on land use planning, urban construction planning and local land funds to regulate the land allocation limit for each household to build their own houses for cases that are not eligible for land allocation under a housing construction investment project in that locality.
Thus, the limit for land allocation to each household is determined by the Provincial People's Committee. Or in other words, the residential land limit of each family in each locality will be different.
