Decision No. 3380/QD-BNNMT announcing newly issued and amended and supplemented administrative procedures in the field of land under the state management scope of the Ministry of Agriculture and Environment effective from August 25, 2025 stipulates land allocation, land lease, and change of land use purpose for cases of land allocation, land lease without auction of land use rights, no bidding to select investors to implement projects using land; cases of land allocation, land lease through bidding to select investors to implement projects using land; land allocation and forest allocation; land lease and forest lease, and extension of land use when the land use term expires.
It clearly stipulates the composition of land allocation and land lease dossiers for agricultural land used by foreign-invested economic organizations and organizations. Specifically:
- Submit to Form No. 01 issued with Decree No. 151/2025/ND-CP amended and supplemented in Decree 226/2025/ND-CP;
- Copies of the Land Use Plan approved by competent agencies and organizations for economic organizations and public service units that have been allocated or leased land by the State before the effective date of the Land Law;
- One of the following documents:
+ Copies of documents approving investment projects, investment policy approval decisions, investment policy approval decisions and investor approval at the same time according to the provisions of law on public investment, law on investment; documents approving investor selection results for investment projects under the public-private partnership method (if any);
+ Photocopy of the document of the competent state agency approving the investor according to the provisions of the law on investment in the case specified in Clause 5, Article 124 of the Land Law;
+ Photocopy of the document of the unit assigned to organize the auction of land use rights regarding the results of the auction of land use rights that do not comply with the provisions of Point b, Clause 6, Article 125 of the Land Law;
+ Photocopy of the document on the results of receiving the transfer of real estate projects according to the provisions of the law on real estate business in the cases specified in Clause 7, Article 124 of the Land Law;
+ Copies of documents as prescribed by law for cases specified in Point i, Clause 1, Article 133 of the Land Law where land must be recovered.
