Pursuant to sub-section 1, Section II, Part VII of Appendix I issued with Decree 151/2025/ND-CP, specific regulations on the dossier for application for extension of land use rights are as follows:
Within the time limit prescribed in Clause 3, Article 172 of the 2024 Land Law, land users who need to extend land use when the land use term expires must submit a set of documents applying for a land use extension to the dossier receiving agency and return the results prescribed in Clause 1, Article 12 of Decree 102/2024/ND-CP.
The dossier includes an application for extension of land use according to Form No. 04 issued with Decree 151/2025/ND-CP and one of the following documents:
(1) One of the certificates specified in Clause 21, Article 3, Clause 3, Article 256 of the 2024 Land Law is specifically as follows:
- The certificate of land use rights and ownership of assets attached to land is a legal document for the State to confirm the legal land use rights and ownership of assets attached to land of people with land use rights and ownership of assets attached to land.
+ Property attached to land granted with a Certificate of land use rights and ownership of assets attached to land is a house or construction works attached to land according to the provisions of law.
+ Certificate of land use rights, house ownership rights and other assets attached to land according to the provisions of relevant laws shall be implemented in accordance with the provisions of the 2024 Land Law with legal value equivalent to the Certificate of land use rights and ownership of assets attached to land in the 2024 Land Law.
- Certificate of land use rights, Certificate of house ownership rights and land use rights, Certificate of house ownership rights, Certificate of construction ownership rights, Certificate of land use rights, house ownership rights and other assets attached to land that have been issued in accordance with the provisions of law on land, law on housing, and construction law before the effective date of the 2024 Land Law (before August 1, 2024) are still legally valid and do not have to be issued to the Certificate of land use rights and ownership of assets attached to land; in case of need, they will be issued to the Certificate of land use rights and ownership of assets attached to land in accordance with the provisions of the 2024 Land Law.
(2) Land allocation decisions, land lease decisions, decisions allowing change of land use purpose by competent state agencies in accordance with the provisions of the law on land through the periods;
(3) Documents of competent authorities allowing an extension of the investment project's operating period or showing the investment project's operating period according to the provisions of the law on investment in cases of land use to implement investment projects.
