Pursuant to Part XI, Chapter C of Appendix I issued with Decree 151/2025/ND-CP, the order and procedures for granting Red books in cases where "land use rights have been transferred but the transfer procedures have not been carried out according to regulations".
Procedures for granting red books for land that has been sold for a long time but has not yet completed the procedures for transferring land use rights are as follows:
(1) In the following cases of land use due to receiving a transfer of land use rights not in accordance with the provisions of law but with the signatures of relevant parties but not yet granted a Red Book and not falling under the provisions of law), the land user shall carry out the procedures for land registration, issuance of a Red Book (Certificate of land use rights, ownership of assets attached to land) for the first time according to the provisions of the Land Law and the provisions of this Decree without having to carry out the procedures for transfer of land use rights; the dossier receiving agency shall not request the receiver to submit the contract or document on transfer of land use rights according to the provisions of law, except in cases of documents on receiving inheritance of land use rights according to the provisions of Point d, Section 1, Part I of " PART B".
- Using land due to receiving a transfer of land use rights before July 1, 2014 in cases where there are no documents on land use rights as prescribed in Article 137 of the 2024 Land Law;
- Using land due to receiving a transfer of land use rights before August 1, 2024 with documents on land use rights as prescribed in Article 137 of the 2024 Land Law;
- Using land due to receiving a transfer of land use rights from the inheritor of land use rights as prescribed in Clause 4, Article 45 of the 2024 Land Law;
(2) In case the person using the land is receiving the transfer of land use rights before August 1, 2024 but the land plot has a Certificate and the transferee of land use rights only has a Certificate issued to the land plot with documents on receiving the transfer of land use rights or only has a contract or document on the transfer of land use rights established according to regulations, the following shall be done:
- Land users submit an application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree 151/2025/ND-CP and contracts and documents on transferring land use rights established according to regulations in cases where there is only a contract or document on transferring land use rights established according to regulations but the transferor does not hand over the Certificate to the transferee.
+ In case of receiving a transfer of land use rights but without a contract or document as prescribed, submit the Application for registration of changes in land and assets attached to land according to Form No. 18 issued with this Decree, the original issued Certificate, documents on the transfer of land use rights with full signatures of the transferor and the transferee;
- The Land Registration Office shall notify in writing the transferee and the People's Committee of the commune where the land is located to publicly post the procedures for granting a Certificate of land use rights and ownership of assets attached to the land to the transferee.
+ In case the address of the transferee is unknown for notification, the Land Registration Office will post the notice 3 times on local mass media, the cost of posting the notice will be paid by the person requesting the issuance of the Certificate of Land Use Rights and Property Ownership Rights attached to the land;
- After 30 days from the date of notification or first posting in the local mass media without a request for dispute resolution, the Land Registration Office shall issue a red book to the home buyer; in case the transferor fails to submit the issued Certificate, the issued Certificate shall be canceled.
+ In case there is a request for dispute resolution, the Land Registration Office will guide the parties to submit the application to the competent state agency to resolve the dispute according to regulations.
