The Ministry of Justice has just publicly disclosed the Appraisal Dossier for the draft Law on Housing (amended). In the document submitted for appraisal, the Ministry of Construction had a Report dated September 9 on summarizing the implementation of the 2023 Housing Law.
Regarding the policy of managing and using apartment buildings, the Ministry of Construction said that the 2023 Housing Law and guiding documents have basically created a necessary legal framework to help organizations and individuals participate in managing and using apartment buildings in accordance with regulations, contributing to gradually stabilizing the management, operation, and use of apartment buildings in localities.
Some notable regulations include:
- Regulations on how to calculate logs and technical boxes in determining apartment usable area; specific regulations on how to organize apartment building conference meetings (live, online, ...).
- Regulations on management and handover of technical infrastructure works in apartment building areas after investment, on the order and procedures for handover and receipt of technical infrastructure systems in apartment building areas.
- Regulations on penalties for administrative violations in construction have increased the level of penalties for administrative violations; at the same time, stipulating some additional penalties and sanctions for each specific subject in the management, operation, and use of apartment buildings.
According to reports from localities, to date, there are 3,161 apartment buildings nationwide, mainly concentrated in 2 major cities: Hanoi (with 1,162 apartment buildings) and Ho Chi Minh City (with 1,785 apartment buildings).
Also according to reported data, to date, the number of apartment buildings that have disputes and complaints accounts for about 9.5% of the number of apartment buildings that have organized Conferences or apartment buildings that have elected Management Boards.
In addition, localities have also proactively issued regulations related to the management and use of apartment buildings applied in the area assigned by the Law, contributing to strengthening the management of apartment buildings in the area, and at the same time, the rights of parties (investors, owners, management boards, operating management units) are ensured, implemented, clearly, transparently, gradually limiting the occurrence of complaints related to apartment buildings in the past time.
