The Ministry of Agriculture and Environment has just issued Decision 2304/QD-BNNMT on the announcement of administrative procedures in the field of land under the state management functions of the Ministry of Agriculture and Environment.
Pursuant to the Administrative Procedures issued with Decision No. 2304/QD-BNNMT:
Procedures for correcting issued Certificates apply from July 1, 2025 as follows:
Step 1: Applicants submit their application to one of the following locations in the province:
- In case the first issued Certificate has errors, the dossier must be submitted to the Public Administration Service Center.
- In case the Certificate issued when carrying out the procedures for registration of changes in land and assets attached to land has errors, the dossier must be submitted to the Public Administration Service Center or the Land Registration Office or the Branch of the Land Registration Office.
When submitting the application, the registered candidate can choose to submit a copy of the document and present the original to the officer receiving the application for comparison inspection or submit the original of the document or submit a certified or certified copy of the document; in case of submitting the application online, the submitted document must be digitized from the original or a certified and certified copy of the document.
In case of confirming changes on the issued Certificate, the registration submits the original of the issued Certificate. In case of submitting a copy or digital copy of all documents, when receiving the results of handling administrative procedures, the registered candidate must submit the original documents in the dossier components according to regulations.
Step 2: The dossier receiving agency implements:
- Check the completeness of the dossier components; issue a dossier receipt and schedule a return of results.
In case the documents are not complete, the documents must be returned with the Supplement and Complete Application Form so that the applicant can register to complete and supplement according to regulations.
- In case the Public Administration Service Center receives the dossier:
+ Transfer the dossier to the competent provincial land management agency in case of correction of errors in the first-issued Certificate.
+ Transfer the dossier to the Land Registration Office, Branch of the Land Registration Office in cases of correction of issued Certificates when carrying out procedures for registration of changes in land and assets attached to land with errors.
Step 3:
- In case the correction of the first issued Certificate has errors, the competent provincial land management agency shall:
+ Notify the Land Registration Office to transfer the dossier for the first issuance of a Certificate to the competent land management agency at the provincial level.
+ Check the dossier, make a record of the conclusion on the content and cause of errors. - Confirm the correction on the issued Certificate or newly issued Certificate of land use rights and ownership of assets attached to land.
+ Transfer the dossier to the Land Registration Office to edit and update changes in land records and land database; send the correct Certificate to the dossier receiving agency to give to the granted person.
- In case the issued Certificate is corrected when carrying out procedures for registration of changes in land and assets attached to land with errors, the Land Registration Office or Branch of the Land Registration Office shall:
+ Check and make a record of the conclusion on the content and cause of errors.
+ Confirm the correction on the issued Certificate or newly issued Certificate of land use rights and ownership of assets attached to land.
+ Adjust and update changes in cadastral records and land databases; issue a Certificate or send it to the dossier receiving agency to issue to the granted person.
