On July 30, the People's Committee of Bo Trach District (Quang Binh Province) announced that it had issued a document requesting communes and towns to establish Councils to review and approve each individual and plot of land registered for conversion.
Accordingly, in recent times, the conversion of agricultural land to residential land for households and individuals in Bo Trach District has been carried out in accordance with the Land Law of 2013 and its guiding documents.
However, according to the District People's Committee, some households and individuals, after being permitted to convert the use of land from agricultural to residential, did not use it to build houses as registered but instead subdivided, sold, and transferred the land use rights to others.
To strictly manage the conversion of agricultural land to residential land in the coming time, the People's Committee of Bo Trach District requires communes and towns to establish their own Councils to strictly review and approve each individual and plot of land registered for conversion from agricultural to residential land.
This ensures compliance with the planning approved by competent State agencies, the actual need for residential land of the registrant, and that the plot of land registered for conversion must be an independent agricultural plot, interspersed within residential areas, with an area of 1,000m2 or less.
Additionally, localities in the district must send the review minutes to the District People's Committee and take full responsibility for the accuracy and correctness of the reviewed subjects.
The District People's Committee requires the District Department of Natural Resources and Environment to review and specifically check each agricultural plot registered for conversion to residential land to ensure strict compliance with regulations before advising the District People's Committee to register and request the Provincial People's Committee to approve the plan for converting land use from agricultural to residential land in accordance with legal regulations.
The People's Committee of Bo Trach District clearly states that before advising the district to issue a decision on the conversion of agricultural land to residential land for each subject, the District Department of Natural Resources and Environment must have a strict appraisal report based on the planning and plans approved by competent authorities, ensuring the correct subjects, plots, areas, and actual need for residential land of the subjects according to regulations, and take responsibility before the District People's Committee for the appraisal results; guide the commune and town People's Committees to register the annual land use needs in accordance with legal regulations...
