The Ministry of Construction has just issued Official Dispatch No. 12429/BXD-KTQLXD dated August 7, 2026, sent to the Committee for Petitions and Supervision of the National Assembly and the National Assembly delegation of Vinh Long province to respond to the recommendations of voters in Vinh Long province sent at the 10th Session, 15th National Assembly.
Content of the petition of Vinh Long voters:
Previously, according to Decree No. 15/2021/ND-CP dated March 3, 2021 of the Government detailing a number of contents on construction investment project management, Article 71 stipulates professional experience to be granted a certificate of construction supervision practice:
1. Grade I: Has worked as supervisor or construction site commander or chaired the design and construction of works under the content of the practicing certificate application of at least 1 project from level I or higher or 2 projects from level II or higher in the field of practicing certificate application.
2. Grade II: Has worked as supervisor or construction site commander or chaired the design and construction of works under the content of the practicing certificate application of at least 1 project from level II or higher or 2 projects from level III or higher in the field of practicing certificate application.
3. Grade III: Has participated in construction supervision or participated in construction design or construction of work items under the content of the practicing certificate application of at least 1 project from level III or higher or 2 projects from level IV or higher in the field of practicing certificate application".
Currently, Decree No. 175/2021/ND-CP dated December 30, 2024 of the Government detailing a number of articles and measures to implement the Construction Law on Construction Activity Management, in Article 83 stipulating professional experience to be granted a certificate of construction supervision practice:
1. Grade I: Has been in charge of the professional field of construction supervision of specialized project management boards, regional project management boards or worked as supervising head or chairing the construction design of tasks under the content of requesting a practicing certificate for 1 project from level I or higher or 2 level II projects.
2. Grade II: Has been in charge of the professional field of construction supervision of specialized project management boards, regional project management boards or worked as supervising head or chairing the construction design of tasks under the content of applying for a practicing certificate for 1 level II project or 2 level III projects.
3. Grade III: Has participated in the professional field of construction supervision of specialized project management boards, regional project management boards or construction supervision or construction design of works under the content of requesting a practicing certificate for 1 project from level III or higher or 2 projects of level IV".
Thus, according to the provisions of Article 83 of Decree No. 175/2021/ND-CP, the condition of professional experience "construction site commander" and "construction construction" has been removed to be granted a certificate of professional practice for construction supervision corresponding to the respective ranks. The removal of the above experience has limited the experience of individuals when they want to expand their field of operation (construction construction field to construction construction supervision consulting field). It is respectfully requested that the Ministry of Construction consider adjusting and supplementing Article 83 of Decree No. 175/2021/ND-CP in the direction of calculating professional experience "construction site commander" and "construction construction" to consider granting certificates of professional practice for construction supervision corresponding to the respective ranks".
Regarding voters' recommendations, the Ministry of Construction has issued Document No. 15914/BXD-KTQLXD dated December 25, 2025, sent to the Vinh Long Provincial Delegation to respond to the content of the recommendations.
On December 10, 2025, the National Assembly passed Construction Law No. 135/2025/QH15. The Government has issued Decrees detailing and guiding the implementation of Construction Law No. 135/2025/QH15, including Decree No. 212/2026/ND-CP dated June 17, 2026 Regulating conditions and capacity for construction activities, Information Systems, National Databases on construction activities (effective from July 1, 2026). Accordingly, regarding regulations on the issuance of practicing certificates for construction activities in the field of construction supervision, the Ministry of Construction has further opinions on the content of document No. 15914/BXD-KTQLXD as follows:
The issuance of practicing certificates for construction activities in the field of construction supervision is specified in Article 37 of Decree No. 212/2026/ND-CP. People who are granted practicing certificates in construction supervision in the field of construction supervision are required to have experience in supervising or presiding over the construction design of tasks subject to the content of the practicing certificate application. Construction site commanders are not in the field requiring practicing certificates but need to meet the professional experience conditions specified in Article 38 of Decree No. 212/2026/ND-CP.
