Starting from July 1, 2026, the revised Construction Law officially takes effect. This Law stipulates construction activities; rights, obligations, and responsibilities of agencies, organizations, and individuals in construction activities and state management of construction.
Notably, the revised Construction Law has expanded 8 groups of works that are exempt from construction permits (GPXD).
The first group of works exempted from construction permits are state secret works; urgent and urgent construction works; works under special public investment projects; works under investment projects under special investment procedures;
Temporary construction works according to the provisions of this Law; construction works in land areas used for national defense and security purposes according to the provisions of land law.
The second group includes works under public investment projects, decided to be invested by competent authorities such as: the Prime Minister, heads of central agencies, heads of supreme judicial agencies, State Audit Office, Presidential Office, National Assembly Office, ministries, branches, socio-political organizations and Chairmen of People's Committees at all levels.
The third group, construction works on routes in areas from 2 or more provincial-level administrative units; construction works on routes outside areas oriented for urban development, determined according to urban and rural planning or sectoral detailed planning approved by competent state agencies or approved by competent agencies for route plans.
The fourth group, offshore works belonging to offshore construction investment projects that have been assigned sea areas by competent authorities to implement the project; airports, works at airports, works ensuring flight operations outside airports.
The fifth group, advertising works that are not subject to GPXD according to the provisions of the law on advertising; passive telecommunications technical infrastructure works.
The sixth group, construction works under construction investment projects that have been appraised by specialized construction agencies for Feasibility Study Reports, adjusted Feasibility Study Reports and have been approved according to regulations.
Group seven, level 4 construction works; individual houses under 7 floors, with a total floor area of less than 500m2 are exempt from construction permits if they do not belong to areas with architectural management regulations such as functional areas, urban areas, rural residential areas, urban development areas according to provincial/city planning, general planning of economic zones, national tourist areas, general planning of communes or areas with architectural management regulations.
The eighth group, repair and renovation works inside works or exterior repair and renovation works not adjacent to roads in urban areas that require architectural management according to the regulations of competent state agencies.
The repair and renovation does not change the purpose and function of use, ensuring fire prevention and fighting requirements, and environmental protection.
