The Ministry of Agriculture and Environment received a petition from voters in Hanoi after the 9th Session of the 15th National Assembly with the content: "Request the Government to direct ministries, functional branches, and localities on the communes assigned to manage the land sector in the area to thoroughly and promptly handle the shortcomings and problems arising in land management".
The Ministry of Agriculture and Environment has the following opinion:
The Government has promptly directed ministries and functional branches to remove obstacles and resolve and promptly handle the problems in projects, specifically as follows: The Prime Minister has issued many decisions to establish Working Groups and Steering Committees to remove difficulties and obstacles in project implementation in localities.
Based on Conclusion No. 178-KL/TW dated July 17, 2025 of the Politburo and the Secretariat on continuing to implement tasks to ensure the organization of the apparatus of the two-level administrative units to operate smoothly and effectively; on August 1, 2025, the Ministry of Agriculture and Environment issued Decision No. 2971/QD-BNNMT on the establishment of 10 Working Groups to grasp the situation, guide and answer local difficulties and problems in the agricultural and environmental sector in the first phase of operating the 2-level local government organization model (led by 10 Deputy Ministers of the Ministry);
On August 11, 2025, the Minister of Agriculture and Environment issued Decision No. 3161/QDBNNMT on sending civil servants to localities to support the implementation of tasks in the land sector when implementing the 2-level local government model. The Department of Land Management has assigned 34 civil servants to work in localities.
Regarding the responsibility of provincial and commune levels assigned to manage land in the area, they must completely and promptly handle the shortcomings and arising issues in land management: Article 241 of the 2024 Land Law stipulates the responsibility for detecting, preventing and handling violations of the law on land management and use of People's Committees at all levels; accordingly, the Chairman of the Provincial People's Committee and the Chairman of the Commune People's Committee are responsible for detecting, preventing and promptly handling violations of the law on land management and use in localities according to their authority.
Article 17 of Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government stipulates the division of authority of local authorities at 02 levels, decentralization of authority, decentralization in the land sector. Accordingly, the responsibility of the agency with the function of commune-level land management is to inspect, urge, and guide the performance of public duties of cadres and civil servants; promptly and properly resolve, according to the authority or recommend competent authorities to resolve complaints, denunciations, and recommendations from individuals, organizations, and promptly handle violations of land management and use laws in localities according to their authority; detect and propose timely handling of violations of land laws when performing public duties as prescribed in Clauses 2 and 3, Article 241 of the Land Law.
